City of Hoboken v. ExxonMobil, et al.

These lawsuits suing energy companies ‘to recover the costs’ of damages from global warming are really stacking up now. In addition to Imperial Beach, San Mateo, Richmond, Santa Cruz, Rhode Island, Baltimore, Honolulu, the District of Columbia — just to name a few — Hoboken, New Jersey is among the very latest communities to unwisely join this collection with their with their September 2 filing, Why is this unwise? If the industry defendants’ lawyers decide to prominently challenge the veracity of the core accusation within the lawsuit, namely that fossil fuel industry executives employed ‘shill’ skeptic climate scientists in disinformation campaigns to deliberately deceive the public about the harm of global warming, it could not only expose how Hoboken officials didn’t undertake basic due diligence to check the basic veracity of the accusation, it could also torpedo all the rest of the lawsuits across the country in a similar manner, while further exposing how the mainstream media completely overlooked the obvious faults in these lawsuits and in the 25 year+ history of the basic accusation and the core clique of people who’ve promulgated it. D.C. v ExxonMobil, et. al Pt 2: the “17,000 Scientists” Source Problem

It doesn’t take more than a few seconds of internet searching to discover how the Oregon Petition Project had over 31,000 signers, corroborated not only at the Home Page of the website for the petition itself, but also at sites highly biased against it such as Wikipedia and Desmogblog (that Desmog). But as I showed in my Part 1 dissection of that lawsuit, the District of Columbia Attorney General Karl Racine’s lawsuit only placed the number at 17,000, with no citation source for that number.

State of Minnesota v American Petroleum Institute, ExxonMobil Corp, Koch Industries, Flint Hills Resources

The more frequently these global warming lawsuits appear claiming fossil fuel industry executives paid skeptic climate scientists to participate in sinister disinformation campaign efforts to undercut the ‘settled science,’ the easier it is to show how the ‘evidence’ for that accusation implodes. This Minnesota vs. API, et al. lawsuit, filed on 6/24/20, ends up being a case study on how to commit political suicide, first via its enslavement to the same two sets of worthless ‘leaked industry memos’ which have been floated ever since the 1990s as proof of that corporate / skeptic conspiracy, and second, via its links for copies of those memos from one of the central members of the small clique of enviro-activists who’ve been promulgating them that whole time.

If the Minnesota AG’s office had undertaken the most basic kind of due diligence to find out if the ‘leaked memos evidence’ actually proves the existence of disinformation campaigns, it might not have wasted any taxpayer money filing the lawsuit. Without that ‘evidence,’ the lawsuit would struggle to disprove hugely detailed assessments from skeptic climate scientists, while also trying to prove API and the other defendants ever actually accepted the ‘science’ of the IPCC / Al Gore side of the issue. City and County of Honolulu v. Sunoco LP, et al.

Politicians in Hawaii were threatening to sue Big Energy companies last November for damages from the effects of man-caused global warming. As seen in their press release last week, March 9th, they finally delivered on it. Poor timing for those City/County officials, since the Coronavirus news is overrunning all other news now, but far more important is their poor judgement and lack of due diligence regarding their politically suicidal decision to jump on the bandwagon of the nine other boilerplate global warming lawsuits, which are being handled by the Sher Edling law firm. State of New York v. Exxon / Massachusetts v. Exxon … showcasing Exxon’s evil disinformation campaign?

Never lose sight of how Al Gore said at the 2008 Davos conference that “Exxon Mobil has funded 40 different front groups that have all been a part of a strategic persuasion campaign to, in their own words ‘reposition global warming as theory rather than fact.’” And don’t forget how Gore was a prominent part of a March 2016 announcement by seven Attorneys General (including Massachusetts AG Maura Healey, led by NY AG Eric Schneiderman) regarding their prosecution of Exxon, where he cited Naomi Oreskes in reference to the way Big Oil employed the same people who operated in disinformation campaigns for the tobacco industry to hide the harm of cigarette smoking.

Exxon, in other words, knew their oil products were harming the planet by causing global warming, but hired ‘shill experts’ to hide that by saying global warming was naturally occurring.

Do these Attorneys General-led New York / Massachusetts lawsuits against Exxon present evidence to back up that accusation? Not so much. Or strangely, not at all for the New York one. Continue reading

Brief Of Amici Curiae, Robert Brulle .. Oreskes .. & Geoffrey Supran” Redux — the Baltimore version

Friend of the Court participant Geoffrey Supran trumpeted this Baltimore filing event last week as though it was some marvelous new development in the area of global warming lawsuits. It isn’t. It’s essentially a boilerplate regurgitation of the amici curiae Supran and his associates filed back in early January in California, all the way down to the conclusions which Supran quoted in his Tweet about this one. He inadvertently reinforces this copycat problem by noting how the file can be downloaded from the Sher Edling law firm — the same firm with 9 boilerplate global warming lawsuits against energy companies which I’ve detailed in my Sher Edling “boilerplate”-tagged posts as being enslaved to a solitary piece of worthless evidence used to indict skeptic climate scientists as peddlers of industry-orchestrated disinformation. What Supran does here is reinforce a particularly damaging fatal flaw within those lawsuits. Continue reading

The Roll Call of a Single Source Wipeout, Part 2

In the middle of the summer of 2016, Rhode Island Senator Sheldon Whitehouse participated with his comrades in a U.S. Senate floor speech stunt decrying the hazards of man-caused global warming. His speech contained a roll call of people who supposedly exposed the complicity of skeptic climate scientists in a fossil fuel industry-funded disinformation campaign. Here we go again. When I said in my December 14, 2018 blog post (and its Part 2), that enviro-activists only have a one-trick pony to use in their character assassination efforts against skeptic climate scientists, that’s no exaggeration. Their lack of diversity isn’t restricted to only minor league ‘reporters’ lately, it’s the only thing the most famous accusers have in their arsenal as evidence of a ‘skeptics / fossil fuel industry executives disinformation’ conspiracy. News of this PCFFA lawsuit filing [10/12/20 Author’s addition: the PDF file name changed from “Crab-complaint” to “PCFFA-Complaint”, necessitating a new weblink] came up two weeks ago at Energy in Depth: “Latest Sher Edling Climate Lawsuit Further Exposes Anti-Energy Activist Network.” Others, such as Climate Liability News (CLN: “Commercial Fishermen Sue Fossil Fuel Industry for Climate Impacts“) covered it differently without mentioning any questionable items about the situation.
