{"id":19380,"date":"2026-01-31T16:41:40","date_gmt":"2026-01-31T23:41:40","guid":{"rendered":"http:\/\/gelbspanfiles.com\/?p=19380"},"modified":"2026-02-28T10:45:09","modified_gmt":"2026-02-28T17:45:09","slug":"watch-this-space-michigan-v-bp-plc","status":"publish","type":"post","link":"https:\/\/gelbspanfiles.com\/?p=19380","title":{"rendered":"<i>The People of the State of Michigan v BP P.L.C.<\/i>"},"content":{"rendered":"<p>Readers who are aware of <a href=\"https:\/\/gelbspanfiles.com\/?page_id=18\" target=\"_blank\" rel=\"noopener\">my collective dissections list<\/a> know that I differentiate between <a href=\"http:\/\/gelbspanfiles.com\/?tag=sher-edling-boilerplate\" target=\"_blank\" rel=\"noopener\">&#8216;pure boilerplate copy&#8217; filings<\/a> by the San Francisco law firm Sher Edling and &#8220;<a href=\"http:\/\/gelbspanfiles.com\/?tag=sher-edling-assistance\" target=\"_blank\" rel=\"noopener\">Sher Edling Assistance<\/a>,&#8221; where the latter lawsuits are a small handful seemingly appearing to be independently written in a manner suggesting Sher Edling had no hand in composing them, but then later became directly associated with that firm. My initial prediction back in May 2024 was that Michigan Attorney General Dana Nessel would be committing political suicide if she elected to bring that firm in as &#8216;assisting counsel,&#8217; and <a href=\"https:\/\/gelbspanfiles.com\/?p=16911\" target=\"_blank\" rel=\"noopener\">my update<\/a> 4\u00bd months later detailed how she had indeed made that massively unwise decision official. Time would tell if the filing turned out to be just another filing that copied \u2019n pasted accusation content from prior Sher Edling filings. A good indicator it would was AG Nessel&#8217;s equally unwise choice of the secondary &#8216;assisting law firm&#8217; of DiCello Levitt which &#8211; as I showed <a href=\"http:\/\/gelbspanfiles.com\/?p=16740\" target=\"_blank\" rel=\"noopener\">in my dissection<\/a> of the Pennsylvania <em>Bucks County v BP<\/em> lawsuit &#8211; had essentially plagiarized its material straight out of Sher Edling&#8217;s <em>Chicago v BP<\/em> filing. Notwithstanding the presence of DiCello Levitt <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/04\/Chicagos-DiCello-Levitt-Sher-Edling.jpg\" target=\"_blank\" rel=\"noopener\">having &#8216;top billing&#8217;<\/a> as the assisting firm for <em>Chicago<\/em>, <a href=\"https:\/\/gelbspanfiles.com\/?p=16237\" target=\"_blank\" rel=\"noopener\">my dissection of that one<\/a> showed how it was a <strong><em>typical<\/em><\/strong> Sher Edling boilerplate copy \u2019n paste effort, the latest in a long string of them at the time.<\/p>\n<p>But while this new <a href=\"https:\/\/www.michigan.gov\/ag\/-\/media\/Project\/Websites\/AG\/releases\/2026\/January\/Michigan-Energy-Affordability-Complaint.pdf\" target=\"_blank\" rel=\"noopener\">1\/23\/26 <em>Michigan v BP<\/em> filing<\/a> gives Sher Edling <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-Sher-Edling-top-billing.jpg\" target=\"_blank\" rel=\"noopener\">&#8216;top billing&#8217; for its assistant firms<\/a>, it doesn&#8217;t follow Sher Edling&#8217;s typical copy \u2019n paste template. <!--more--><\/p>\n<p>Right out of the gate, what appears to be &#8216;artful rewriting&#8217; of that template is a detail that could kill the entire climate litigation lawfare effort &#8211; here <strong><em>and<\/em><\/strong> possibly in the UK court system. Hold <em>that thought<\/em> until the very end of this blog post<\/p>\n<p>Meanwhile &#8211; let&#8217;s observe how <em>MI v BP<\/em> appears to be an &#8216;artfully rewritten&#8217; Sher Edling boilerplate copy filing &#8211; less important tell-tale indicators first, then the big blunder last:<\/p>\n<p>\u2713 The &#8220;Joseph Carlson memo&#8221; \u2014 <a href=\"https:\/\/www.michigan.gov\/ag\/-\/media\/Project\/Websites\/AG\/releases\/2026\/January\/Michigan-Energy-Affordability-Complaint.pdf#page=69\" target=\"_blank\" rel=\"noopener\">PDF file page 69, paragraph 152<\/a>. This particular &#8216;memo evidence&#8217; that &#8216;Exxon knew about the harm of global warming&#8217; as far back as several decades ago (Exxon <a href=\"https:\/\/notrickszone.com\/2024\/06\/04\/the-claim-exxon-knew-their-products-induced-catastrophic-climate-impacts-in-the-1970s-is-bunk\/\" target=\"_blank\" rel=\"noopener\">could <strong><em>not<\/em><\/strong> have<\/a>, in the face of all the coverage of the global <em>cooling<\/em> crisis) is endemic among the Sher Edling boilerplate copies, and others which apparently <strong><em>plagiarize<\/em><\/strong> Sher Edling content, e.g. <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Kennedy-plagiarize-Carlson.jpg\" target=\"_blank\" rel=\"noopener\">the Hagens-Berman filing of <em>Kennedy v Exxon<\/em><\/a>. But in Sher Edling&#8217;s boilerplate <em>Maine v BP<\/em>, as I detailed in that one, they oddly switched <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/11\/Maine-Joseph-Carlson.jpg\" target=\"_blank\" rel=\"noopener\">to using &#8220;Perma.cc&#8221; citation links<\/a> for the Carlson memo file scans, unlike their prior habit of just linking to an innocuous-looking &#8220;DocumentCloud&#8221; PDF file (e.g. how they started <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/12\/SMCO-Joe-Carlson.jpg\" target=\"_blank\" rel=\"noopener\">in their 2017 <em>San Mateo v Chevron<\/em> filing<\/a>). Sher Edling&#8217;s May 2025 <em>Hawaii v BP<\/em> boilerplate copy at least saved the firm some virtual ink by re-using <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Hawaii-Carlson-memo.jpg\" target=\"_blank\" rel=\"noopener\">the same Carlson memo Perma link<\/a> as it used in <em>Maine<\/em>. This new <em>MI v BP<\/em> pulls that same new citation link stunt . . . . but here&#8217;s what happens when the layers of that &#8220;Perma.cc&#8221; maneuver are peeled back in the cases of <em>Maine<\/em> \/ <em>Hawaii<\/em> \/ <em>Michigan<\/em> &#8211; doesn&#8217;t matter if you use the <em>Maine<\/em> or <em>Hawaii<\/em> version or <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-Carlson-memo-new-perma.jpg\" target=\"_blank\" rel=\"noopener\">this new <em>Michigan<\/em> version<\/a>:<\/p>\n<p>\u2022 Click on <a href=\"https:\/\/perma.cc\/4CSM-6NCB\" target=\"_blank\" rel=\"noopener\">the Perma link<\/a> &#8211; it takes you to that organization&#8217;s showing of <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-new-perma-Carlson-scan.jpg\" target=\"_blank\" rel=\"noopener\">the 8-page memo scans<\/a><br \/>\n\u2022 Click on its &#8220;View the live page&#8221; link &#8211; it takes you <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-s3-DocCloud-Carlson-scan.jpg\" target=\"_blank\" rel=\"noopener\">to an &#8220;s3.documentcloud&#8221; page<\/a> with the full url PDF file address spelled out<br \/>\n\u2022 Take that PDF file address and swap out <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/DocCloud-innoc-PDF-to-Davies-upload.jpg\" target=\"_blank\" rel=\"noopener\">what I have in red in this illustration<\/a> with the very small little differences in the address and enter that into the web browser<br \/>\n\u2022 Where <a href=\"https:\/\/www.documentcloud.org\/documents\/3024180-1998-Exxon-Memo-on-the-Greenhouse-Effect\/\" target=\"_blank\" rel=\"noopener\">do you land<\/a>? At <strong>Kert Davies&#8217; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Davies-CIC-Carlson-DocCloud-upload.jpg\" target=\"_blank\" rel=\"noopener\">Climate Investigations Center<\/a><\/strong> upload of that old memo scan<\/p>\n<p>For any newly arrived readers here at my GelbspanFiles blog reading my material for the first time, Kert Davies is not simply just some benign investigator, he is <strong><em>that<\/em><\/strong> Kert Davies, please see my extensive background info post about him <a href=\"https:\/\/gelbspanfiles.com\/?p=19118\" target=\"_blank\" rel=\"noopener\">here<\/a>; he&#8217;s a central figure <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/4-accusation-elements-Soon-39.jpg\" target=\"_blank\" rel=\"noopener\">behind the 4 central accusation elements<\/a> about &#8216;<em>skeptic climate scientists being paid industry money to spread disinformation<\/em>,&#8217; an enviro-activist apparently with <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/11\/Davies-Passac-Wasserman-suspects.jpg\" target=\"_blank\" rel=\"noopener\">a vendetta against the industry<\/a> that dates back to the late 1990s. Hold that thought about his name, it will come up again in the next checklist \u2713 item. Meanwhile &#8211; all of the above surrounding a 1988 Exxon memo which does nothing to prove they or other fossil fuel companies knew with any certainty the use of their products caused catastrophic global warming.<\/p>\n<p>\ud83d\udeab Missing &#8220;Richard Lawson memo&#8221; \u2013 which has otherwise been another of several tell-tale repetitions in Sher Edling boilerplate copy lawsuits. This is not the first time that one has gone missing, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Chicago-Oreskes-extraneous-source.jpg\" target=\"_blank\" rel=\"noopener\">as I mentioned<\/a> in my dissection <a href=\"https:\/\/gelbspanfiles.com\/?p=16237\" target=\"_blank\" rel=\"noopener\">of their <em>Chicago v BP<\/em> filing<\/a>. But she was not missing completely in <em>Chicago<\/em>, she&#8217;s cited just the same way in <em>Michigan<\/em> as an extraneous source &#8230; except in a manner that&#8217;s simply not-well-thought-out at two separate levels. First, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-cites-Oreskes.jpg\" target=\"_blank\" rel=\"noopener\">this filing cites<\/a> her November 2021 UK <em>Guardian<\/em> article as a source about an alleged American Petroleum Institute ad about &#8216;natural gas being &#8220;essential to address climate change.&#8221; Her own article is disingenuous <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Oreskes-Grauniad-API-alleged-ad.jpg\" target=\"_blank\" rel=\"noopener\">about the portrayal<\/a> of what is actually a corporate sponsored <a href=\"https:\/\/www.washingtonpost.com\/brand-studio\/wp\/2020\/12\/14\/real-climate-solutions-wont-happen-without-natural-gas-and-oil\/\" target=\"_blank\" rel=\"noopener\">1,350 word+ op-ed piece<\/a> &#8211; which nobody would mistake it for being just a regular advertisement in any traditional sense. It&#8217;s quite odd <em>Michigan<\/em> cites Oreskes in this manner \u2013 hold <strong><em>that<\/em><\/strong> particular thought until I get to the last checklist item.<\/p>\n<p>Now, lets look for the 4 central accusation elements checklist items which are tell-tale repetitions in Sher Edling boilerplate copy lawsuits:<\/p>\n<p>\u2713 <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/08\/Ye-olde-explanatione.jpg\" target=\"_blank\" rel=\"noopener\"><em>Ye olde<\/em><\/a> oft-repeated (but <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/MJones-victory-doubt-never-impl.jpg\" target=\"_blank\" rel=\"noopener\">never implemented<\/a>!) &#8220;victory will be achieved memos \u2014 <a href=\"https:\/\/www.michigan.gov\/ag\/-\/media\/Project\/Websites\/AG\/releases\/2026\/January\/Michigan-Energy-Affordability-Complaint.pdf#page=72\" target=\"_blank\" rel=\"noopener\">PDF file page 72, paragraph 159<\/a>. This basic accusation in Sher Edling&#8217;s prior two boilerplate copy filings &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/11\/Maine-victory.jpg\" target=\"_blank\" rel=\"noopener\"><em>Maine<\/em><\/a> and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/05\/Hawaii-victory.jpg\" target=\"_blank\" rel=\"noopener\"><em>Hawaii<\/em><\/a> &#8211; had the same wording and even the same &#8220;Perma.cc&#8221; citation source link, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/GF-Hawaii-Maine-leads-to-Davies.jpg\" target=\"_blank\" rel=\"noopener\">as I noted<\/a> in my <a href=\"https:\/\/gelbspanfiles.com\/?p=18482\" target=\"_blank\" rel=\"noopener\">dissection of <em>Hawaii<\/em><\/a>, the huge problem there was the &#8216;hidden source&#8217; trick that nevertheless led ultimately to &#8211; here&#8217;s that name again &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/09\/DocCloud-Victory-Davies-copy2.jpg\" target=\"_blank\" rel=\"noopener\">Kert Davies&#8217; internet upload of the worthless memo<\/a> <strong><em>when he worked at Greenpeace.<\/em><\/strong> However, here in <em>Michigan<\/em> <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-v-BP-victory.jpg\" target=\"_blank\" rel=\"noopener\">the wording is different<\/a>, and its &#8220;Perma.cc&#8221; citation source link is brand-new . . . . which is actually a huge problem. <em>Michigan<\/em>&#8216;s identifies their source straightaway as being an upload made by the &#8220;Inside Climate News&#8221; (ICN) organization. By doing that, <em>Michigan<\/em> is technically hiding the original source for those horrid photocopy scans behind what appears to be &#8211; at first glance &#8211; a benign &#8216;news&#8217; investigations organization.<\/p>\n<p>\u2022 <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/GF-ICN-not-what-appears-to-be.jpg\" target=\"_blank\" rel=\"noopener\">As I showed<\/a> in my <a href=\"https:\/\/gelbspanfiles.com\/?p=14080\" target=\"_blank\" rel=\"noopener\">Aug 2022 blog post<\/a>, ICN&#8217;s benign appearance is betrayed by their original name, &#8220;Solve Climate News.&#8221; &#8216;Solving&#8217; the &#8216;climate crisis&#8217; is a political agenda.<br \/>\n\u2022 <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/GF-Arkush-ICN-Davies.jpg\" target=\"_blank\" rel=\"noopener\">As I showed<\/a> in my July 2024 blog post <a href=\"http:\/\/gelbspanfiles.com\/?p=17060\" target=\"_blank\" rel=\"noopener\">dissecting a proposal to prosecutors<\/a> for filing &#8216;climate homicide charges,&#8217; ICN&#8217;s PDF file for the &#8220;victory will be achieved&#8221; memo is <strong><em>identical<\/em><\/strong> to Kert Davies&#8217; upload via his Climate Investigations Center and via his several years earlier Greenpeace upload.<br \/>\n\u2022 Thus, no need for any subsequent new uploads of the same degraded photocopies when the one at Greenpeace USA will suffice.<\/p>\n<p>\u2713 &#8220;Bankroll&#8221; scientists&#8221; (a.k.a., the Willie Soon accusation) \u2014 <a href=\"https:\/\/www.michigan.gov\/ag\/-\/media\/Project\/Websites\/AG\/releases\/2026\/January\/Michigan-Energy-Affordability-Complaint.pdf#page=84\" target=\"_blank\" rel=\"noopener\">PDF file pages 84-85, paragraph 187<\/a>. Over the many years of Sher Edling filing their boilerplate copy lawsuits, they were quite consistent in this instance of using the word &#8220;bankroll,'&#8221; the majority of my screencaptures in <a href=\"http:\/\/gelbspanfiles.com\/?p=17994\" target=\"_blank\" rel=\"noopener\">my blog post list of lawsuits<\/a> hurling that accusation at Dr Soon show the sheer repetition of that word in their filings. Click on <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/GF-bankroll-plagiarism.jpg\" target=\"_blank\" rel=\"noopener\">the screencaptures I&#8217;ve underlined<\/a> within my list <a href=\"https:\/\/gelbspanfiles.com\/?p=18393\" target=\"_blank\" rel=\"noopener\">of other lawsuits apparently plagiarizing<\/a> Sher Edling content, and you&#8217;ll see the same &#8220;bankroll&#8221; repetition in those. While <em>Michigan<\/em> regurgitates the same basic accusation element about &#8220;$1.2 million,&#8221; it departs significantly from the standard template. In prior Sher Edling filings, the main &#8216;source&#8217; for the bit about Dr Soon &#8216;failing to disclose his funders&#8217; was a Smithsonian press release from Dr Soon&#8217;s employer about an investigation into the matter, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/10\/DelawareSoon.jpg\" target=\"_blank\" rel=\"noopener\">then a link to the archive version of the press release<\/a> after the Smithsonian took it offline (Dr Soon says its departure resulted from <a href=\"https:\/\/www.youtube.com\/watch?v=oOY_wRICi7k\" target=\"_blank\" rel=\"noopener\">Smithsonian&#8217;s internal investigation finding no wrongdoing<\/a> on his part). However, rather than cite any new or contrary investigation results from Smithsonian, Sher Edling continued that reckless pattern right into their just-previous May 2025 boilerplate copy, <em>Hawaii v BP<\/em> &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/05\/Hawaii-v-Soon.jpg\" target=\"_blank\" rel=\"noopener\">their Perma.cc link for their footnote citation #260<\/a> is nothing more than their prior Internet Archive link.<\/p>\n<p><em>Michigan<\/em> doesn&#8217;t bring up that <em>fatally<\/em> faulty Smithsonian citation source at all, they instead <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-v-Soon.jpg\" target=\"_blank\" rel=\"noopener\">label Dr Soon as a &#8216;cartel associate,&#8217;<\/a> and with regard to the balance of their accusation &#8230;. they offer no citation source whatsoever. <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-v-Soon-no-citations.jpg\" target=\"_blank\" rel=\"noopener\"><strong>None.<\/strong><\/a> Damaging as the word &#8220;deliverables&#8221; might be in that passage, even the supporters at the pro-global warming Desmogblog website <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Desmogblog-deliv-oops2.jpg\" target=\"_blank\" rel=\"noopener\">think it is paper thin<\/a>.<\/p>\n<p><em>Michigan<\/em> covered the two last of the standard 4 main accusation elements in one paragraph, potentially making one of the more prominent mistakes they could possibly make.<\/p>\n<p>\u2713 The &#8220;reposition global warming&#8221; memos \/ &#8220;Chicken Little&#8221; \/ &#8220;Doomsday&#8221; &#8216;advertorials&#8217; \u2014 <a href=\"https:\/\/www.michigan.gov\/ag\/-\/media\/Project\/Websites\/AG\/releases\/2026\/January\/Michigan-Energy-Affordability-Complaint.pdf#page=70\" target=\"_blank\" rel=\"noopener\">PDF file pages 70-71, paragraph 156<\/a>. Again, identical to the above accusation about the &#8220;victory will be achieved&#8221; memo, there is <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-reposit-no-citation.jpg\" target=\"_blank\" rel=\"noopener\">zip, zero, nada citation source<\/a> about the &#8220;reposition&#8221; memo or the two &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-Chicken-Doomed.jpg\" target=\"_blank\" rel=\"noopener\"><strong>just two! <\/strong><\/a>&#8211; references about newspaper advertorials. Is that a clumsy oversight mistake made by some <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Hes-fired.jpg\" target=\"_blank\" rel=\"noopener\">inept law firm intern<\/a> working for <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/11\/MI-AG-chooses.jpg\" target=\"_blank\" rel=\"noopener\">one of the three<\/a>?<\/p>\n<p>\u2022 It would have been a snap for an intern to put in a footnote citation reading,<\/p>\n<p>&#8220;<em>supra<\/em> note 55, Geoffrey Supran and Naomi Oreskes, <em>The Forgotten Oil Ads That Told Us Climate Change Was Nothing<\/em>, The Guardian 193\u2013199&#8243; &#8230;<\/p>\n<p>&#8230;&#8230;.. oh, wait, that&#8217;s the article I mentioned in my &#8220;\ud83d\udeab Missing Richard Lawson memo&#8221; above, where Naomi Oreskes shows the same two never-published memos, the same never-implemented memo directive, but <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Oreskes-ICE-contradicts-Sher-Edling.jpg\" target=\"_blank\" rel=\"noopener\">contradicts this lawsuit filing<\/a> by <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/03\/Oreskes-expert-informed-reposit.jpg\" target=\"_blank\" rel=\"noopener\">labeling the PR campaign<\/a> with a name <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/11\/NYT-advice-unsold.jpg\" target=\"_blank\" rel=\"noopener\">they never operated under<\/a>. The <a href=\"https:\/\/gelbspanfiles.com\/?p=17358\" target=\"_blank\" rel=\"noopener\">same Oreskes<\/a> who is on retainer &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Shes-fired.jpg\" target=\"_blank\" rel=\"noopener\">ineptly<\/a>? &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/06\/GF-Oreskes-on-retainer.jpg\" target=\"_blank\" rel=\"noopener\">with Sher Edling<\/a>.<br \/>\n\u2022 It would have been a snap for an intern to copy \u2019n paste the same <strong><em>trio<\/em><\/strong> of ICE newspaper advertorials citation sources Sher Edling has used in its boilerplate copy lawsuits, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/12\/Hawaii-ICE-ads-with-label.jpg\" target=\"_blank\" rel=\"noopener\">e.g. in <em>Hawaii<\/em><\/a>, along with the same citation source for the collective accusation about the memo and ads, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/RI-v-Chevron-reposit-UCS.jpg\" target=\"_blank\" rel=\"noopener\">e.g. in <em>Rhode Island v Chevron<\/em><\/a> &#8230;&#8230;.. oh, wait, in every lawsuit where Sher Edling cites the Union of Concerned Scientists &#8216;dossier,&#8217; it always points to the citation cascade problem where <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/11\/UCS-cites-GP-OA.jpg\" target=\"_blank\" rel=\"noopener\">UCS&#8217; citation source<\/a> is the old &#8220;Greenpeace USA n\u00e9e Ozone Action&#8221; <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/GPOA-strat-target-Chicken-flat-1024x886.jpg\" target=\"_blank\" rel=\"noopener\">degraded photocopy scans collection<\/a> &#8211; the ones <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/08\/GPOA-ChickenDoomsdayMostSerious.jpg\" target=\"_blank\" rel=\"noopener\">proving Sher Edling cropped the main body text out<\/a> of the one advertorial that actually <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/The_Park_City_Daily_News_Fri__May_24__1991_.pdf\" target=\"_blank\" rel=\"noopener\"><em>was<\/em> published<\/a>. <strong><em>That<\/em><\/strong> Ozone Action, the place where Kert Davies &#8211; there&#8217;s that name again &#8211; worked <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/02\/OA-staff-Jan-99.jpg\" target=\"_blank\" rel=\"noopener\">back in the late 1990s<\/a>.<br \/>\n\u2022 It would have been a snap for an intern to create a Perma.cc link to Vic Sher&#8217;s own <a href=\"https:\/\/www.youtube.com\/watch?v=eCsg9ACPex4&amp;t=1672s\" target=\"_blank\" rel=\"noopener\">2017 Youtube video presentation about the ICE ads<\/a> since he is the lead expert lawyer for these lawsuits &#8230;&#8230;.. <a href=\"https:\/\/gelbspanfiles.com\/?p=15017\" target=\"_blank\" rel=\"noopener\">oh, wait<\/a>, Vic Sher <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Vics-Big-Mistakes.jpg\" target=\"_blank\" rel=\"noopener\">cannot keep his details straight<\/a> on those if his reputation depended on it.<br \/>\n\u2022 It apparently was a snap for an intern transcribe the lousy ad text out of the &#8220;Chicken Little&#8221; \/ &#8220;Doomsday&#8221; &#8216;advertorials&#8217; &#8230;&#8230;.. but apparently not so much to additionally transcribe <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-v-GP-Chicken.jpg\" target=\"_blank\" rel=\"noopener\">the non-existent toll-free number in one<\/a> and the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-v-GP-Doomsday.jpg\" target=\"_blank\" rel=\"noopener\">never-used PR campaign name in both<\/a>, the latter embarrassingly undercutting what <em>Michigan<\/em> says is the name of the campaign. But if a hapless intern had included those faults along with the two degraded &#8220;Greenpeace USA n\u00e9e Ozone Action&#8221; ad scans &#8230; which law firm administrator made sure the incorrect names and lousy scans didn&#8217;t make it into this filing?<\/p>\n<p>One more thing: <em>Michigan<\/em>&#8216;s paragraph #157 following right after the &#8220;reposition&#8221; memo \/ <strong><em>non-<\/em><\/strong>ICE ads &#8211; want to see where its words &#8220;<em>ICE also made its own &#8216;science advisory panel&#8217;<\/em> in an eerily similar way? They&#8217;re <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/Michigan-vs-OA-Sci-Advise-Panel.jpg\" target=\"_blank\" rel=\"noopener\">in the very same old Ozone Action page<\/a> I&#8217;ve been pointing to for <em>years<\/em> on the connection of my blog&#8217;s namesake Ross Gelbspan to &#8211; here&#8217;s that name again &#8211; <a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/11\/Davies-LinkedIn-Nov25.jpg\" target=\"_blank\" rel=\"noopener\">Kert Davies old workplace<\/a>. Coincidence? Probably not.<\/p>\n<p><strong><em>None<\/em><\/strong> of all that is good at all for Michigan AG Dana Nessel. Also not helping her one bit &#8211; or the wider litigation lawfare effort that may (emphasis on the word &#8220;may&#8221;) now include the <a href=\"https:\/\/gelbspanfiles.com\/?p=19207\" target=\"_blank\" rel=\"noopener\">UK High Court-filed <em>Casquejo v Shell PLC<\/em> lawsuit<\/a> &#8211; was her choice of Hausfeld LLP as her <strong>third assisting law firm<\/strong> in this case.
