{"id":18081,"date":"2025-01-20T15:22:46","date_gmt":"2025-01-20T22:22:46","guid":{"rendered":"http:\/\/gelbspanfiles.com\/?p=18081"},"modified":"2025-01-20T15:38:22","modified_gmt":"2025-01-20T22:38:22","slug":"the-fossil-fuel-industry-ran-disinfo-campaigns-our-assumption-is-they-did","status":"publish","type":"post","link":"https:\/\/gelbspanfiles.com\/?p=18081","title":{"rendered":"The Fossil Fuel Industry Ran Disinfo Campaigns &#8211; &#8216;our ASSUMPTION is they did&#8217;"},"content":{"rendered":"<p>Emphasizing for the benefit of congressional investigators \/ law firms representing defendants in the &#8220;ExxonKnew&#8221; lawsuits \/ genuinely objective journalists: It does not matter <em>where<\/em> you drop into the collective accusation about the fossil fuel industry employing skeptic climate shills to spread disinformation \u2014 you&#8217;ll never find tidy answers tying up situations, you&#8217;ll find problems that only lead you onto a path of finding endless related problems. It never ends, no matter where you start. The example in this blog post concerns an item within <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/09\/Roland-C-Davies.jpg\" target=\"_blank\" rel=\"noopener\">Roland C<\/a> &#8220;Kert&#8221; Davies&#8217; 20<strong>11<\/strong> version of his false accusation that Harvard Center for Astrophysics&#8217; Dr Willie Soon was supposedly paid by Exxon to lie. I showed <a href=\"http:\/\/gelbspanfiles.com\/?p=17994\" target=\"_blank\" rel=\"noopener\">in my prior blog post<\/a> the &#8220;ExxonKnew&#8221; lawsuits in which Davies 20<strong>15<\/strong> rehashed accusation is their source &#8211; but while compiling that list and the brief timeline of prior accusations leading to the 20<strong>15<\/strong> rehash, I spotted how Davies tangentially said something in his announcement of the 20<strong>11<\/strong> version which essentially <strong>undermines<\/strong> one of the other of the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/ExxKnew-4-accusation-elements.jpg\" target=\"_blank\" rel=\"noopener\">four central accusation elements<\/a> at the heart of most of these lawsuits.<!--more--><\/p>\n<p>Davies&#8217; <a href=\"https:\/\/web.archive.org\/web\/20210926133710\/https:\/\/www.greenpeace.org\/usa\/dr-willie-soon-a-career-fueled-by-koch-big-oil-and-coal\/\" target=\"_blank\" rel=\"noopener\">June 28, 2011 Greenpeace announcement<\/a> concerned his very first &#8220;Exxon $1.2 million&#8221; accusation effort. He should have stuck to that attack exclusively, but he could not resist inserting one of the other accusation elements into his announcement, namely the meritless one (I have <a href=\"http:\/\/gelbspanfiles.com\/?cat=165\" target=\"_blank\" rel=\"noopener\">a whole tag category<\/a> on it) about the 1998 American Petroleum Institute &#8220;victory will be achieved&#8221; memo set. <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Davies-GP-2011-v-Soon-API.jpg\" target=\"_blank\" rel=\"noopener\">Observe<\/a>:<\/p>\n<blockquote><p>In 1998, the API, ExxonMobil and the Southern Company sat round a table with other oil companies and think tanks they plotted and funded a Global Climate Science Communications Plan to undermine the climate science and support for the Kyoto Protocol that had just been agreed. &#8220;<strong>Victory will be achieved when\u2026 average citizens \u2018understand\u2019 (recognize) uncertainties in climate science<\/strong>&#8220;\u2026 read the plan. &#8220;Uncertainty&#8221; was also their objective for the media. The detail funding sources from corporate purses going to <strong>think tanks and front groups who will coach scientists<\/strong> with messages counter to the rising consensus on the global warming crisis. <span style=\"color: #ff0000;\">Even though this \u2018scandal\u2019 was front page news at the New York Times, <strong>our assumption<\/strong> is they did it anyway<\/span>.<\/p><\/blockquote>\n<p>His setup prior to this paragraph was to claim an assortment of fossil fuel companies were funding Dr Soon. After the paragraph, he resumed his attack. The paragraph, in addition to being oddly and poorly written, has problems on several levels.<\/p>\n<ul>\n<li>There was never a plan to undermine climate science. The <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/05\/Joe-1Day-Walker.jpg\" target=\"_blank\" rel=\"noopener\">single-day meeting<\/a> was nothing more than a session on how to counter the Kyoto Protocol, but the brainstorming ultimately became a moot point because everyone involved figured out that there was no way the U.S. Senate would cede any power to authorities outside the U.S. The &#8216;plan&#8217; was never implemented in any form, there was no need for Kyoto Treaty countermeasures.<\/li>\n<li>It would be a victory for anybody to achieve if they could break through to the public on how particular policy suggestions are deceptive when critical details are withheld from the public. The global warming issue <a href=\"http:\/\/gelbspanfiles.com\/?page_id=3834\" target=\"_blank\" rel=\"noopener\">withholds viewpoints<\/a> from skeptic scientists who say the whole issue is massively overblown.<\/li>\n<li>Yes, the <em>NYT<\/em> reported about the leak of the API memo in its April 26, 1998 &#8220;<a href=\"https:\/\/www.nytimes.com\/1998\/04\/26\/us\/industrial-group-plans-to-battle-climate-treaty.html\" target=\"_blank\" rel=\"noopener\">Industrial Group Plans to Battle Climate Treaty<\/a>&#8221; article \u2014 read through the whole article, however, and you&#8217;ll won&#8217;t see a single word quoting the specific &#8220;victory will be achieved&#8221; &#8216;smoking gun&#8217; phrases which are <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Victory-will-be-this.jpg\" target=\"_blank\" rel=\"noopener\">the key identifiers<\/a> of this memo set. Nobody would know that memo phrase belonged to that memo set from reading that article.<\/li>\n<\/ul>\n<p>The last two sentences of Kert Davies&#8217; above paragraph are where the fatal problems are, one at a basic level concerning Davies&#8217; lack of understanding how science works, and the other which illustrates how <strong>outright defamation<\/strong> happens.<\/p>\n<p>Let&#8217;s start with the first basic problem \u2014 he contends the fossil fuel industry pays think tanks \/ front groups to &#8220;<em>coach scientists with messages counter to the rising consensus on the global warming crisis<\/em>.&#8221;<\/p>\n<ul>\n<li>Think tanks \/ front groups do not coach PhD-level skeptic scientists what to say. That notion is beyond ludicrous. Science conclusions are not validated by &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/02\/Singer-show-of-hands-Sept-04.jpg\" target=\"_blank\" rel=\"noopener\">a show of hands<\/a>,&#8221; it is <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/02\/Monckton-consensus-fallacy2.jpg\" target=\"_blank\" rel=\"noopener\"><strong><em>not<\/em><\/strong> how the Scientific Method works<\/a>. If any dumb think tank operative said &#8220;<em>the scientific consensus is not trending our way, so we need to tilt it back to our favo<\/em>r,&#8221; he&#8217;d be read the riot act by the scientists. Skeptic scientists coach the people at think tanks who don&#8217;t have science expertise on what the facts are, and where the blatant mistakes are in IPCC climate assessment reports.<\/li>\n<li>Skeptic scientists and other related experts <a href=\"https:\/\/clintel.org\/world-climate-declaration\/\" target=\"_blank\" rel=\"noopener\">who&#8217;ve signed the declaration<\/a> that there is no climate crisis can explain why they hold that position in so much fine detail that it would give average citizens migraine headaches from trying to absorb it all.<\/li>\n<\/ul>\n<p>So, how do you steer average citizens and supposedly objective journalists away from any effort to absorb those details? You say the skeptics were paid to lie, and the proof of this treachery was a memo shared among a huge array of fossil fuel execs saying they&#8217;d achieve a sinister victory if they misled the public into thinking there&#8217;s no science consensus on the matter.<\/p>\n<p>That&#8217;s where the fatal fault in Kert Davies&#8217; above paragraph comes in.<\/p>\n<p>When worded in a way easier to understand: &#8216;<em>Fossil fuel execs were caught red-handed by the NYT coaching the skeptics they paid to lie; rather than stop this scandalous act, <span style=\"color: #000000;\"><strong>our assumption<\/strong><\/span> is they did it anyway<\/em>.&#8221;<\/p>\n<p>See that? Kert Davies&#8217; entire accusation about the &#8220;victory will be achieved&#8221; memos being a template for the entire fossil fuel industry to follow is based . . . . . . . . . on his <strong>assumption.<\/strong><\/p>\n<p>The <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/07\/NYTvSullivan-false-or-reckless-disregard.jpg\" target=\"_blank\" rel=\"noopener\">accepted definition of defamation<\/a> is that a person may not make a false statement against someone knowing it is false, and they cannot make an accusatory statement against someone with reckless regard to whether it is true <strong><em>or not.<\/em><\/strong> It would be hard to make the case that what Kert Davies said there was just <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/10\/def-of-Defamation-confirmed.jpg\" target=\"_blank\" rel=\"noopener\">an innocent unintentional falsehood<\/a>.<\/p>\n<p>Further along in his 2011 Greenpeace announcement, Davies says &#8220;<em>Together with his colleague at the SAO, Sallie Baliunas, they brought in $1,153,000 since 2001<\/em>.&#8221; Well, wait a minute now. That wipes out the accusation <a href=\"https:\/\/www.google.com\/search?q=%22%241.2+million%22+%22Wei-Hock+Soon%22\" target=\"_blank\" rel=\"noopener\">hurled by accusers<\/a> that Dr Soon alone got the rounded-up $1.2 million figure. What&#8217;s the money split between the two scientists? Dr Soon got an even million and Dr Baliunas got $153 grand? He got $576,500 and she got the other half? She got $700 grand and he only got $453 grand? Kert Davies only mentions Dr Baliunas one more time in his 2011 announcement, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Baliunas-only-twice.jpg\" target=\"_blank\" rel=\"noopener\">only in a parenthetical way, too<\/a>.<\/p>\n<p>The full 2011 Greenpeace report (archived with irrelevant html code gibberish on top) <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Baliunas-GP-16-1.jpg\" target=\"_blank\" rel=\"noopener\">mentions Dr Baliunas&#8217; name 16 times<\/a>, as does the more readable updated Greenpeace 2013 version (the screen search feature <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Baliunas-GP-2013-16-1.jpg\" target=\"_blank\" rel=\"noopener\">shows 17 there<\/a> because there is one extra <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Baliunas-GP-ISs-17-1.jpg\" target=\"_blank\" rel=\"noopener\">in the archive&#8217;s header area<\/a>). The title of Davies&#8217; Greenpeace announcement, however, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Soon-not-Soon-Baliunas.jpg\" target=\"_blank\" rel=\"noopener\">is <em>not<\/em><\/a> &#8220;Dr Willie Soon <strong>&amp;<\/strong> Dr Sallie Baliunas: <strong>Two<\/strong> Career<strong>s<\/strong> Fueled by Koch, Big Oil and Coal.&#8221; In the UK <em>Guardian<\/em> newspaper&#8217;s same-day June 28, 2011 article about Davies&#8217; report, Davies himself <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Davies-Soon-pawn.jpg\" target=\"_blank\" rel=\"noopener\"><strong><em>does not say<\/em><\/strong><\/a> &#8220;Scientists like Dr Soon <strong><em>and<\/em><\/strong> Dr Baliunas \u2026 are pawns,&#8221; nor does the article headline say &#8220;Climate sceptics Willie Soon <strong><em>and<\/em><\/strong> Sallie Baliunas received $1m.&#8221; It only mentions Dr Baliunas&#8217; name once, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Graunidad-Baliunas-only-once.jpg\" target=\"_blank\" rel=\"noopener\"><em>not<\/em> in any connection to funding<\/a>.<\/p>\n<p>See the problem there? Was it an unintentional falsehood by Kert Davies and the <em>Guardian<\/em> to only name Dr Soon as an industry-paid pawn and exclude Dr Baliunas?<\/p>\n<p>Carry this through all the way to the present day into the &#8220;ExxonKnew&#8221; lawsuits, the bulk of which are handled by the San Francisco law firm Sher Edling (<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Vermont-v-SMCO-v-Soon.jpg\" target=\"_blank\" rel=\"noopener\">other law firms<\/a> seem to plagiarize <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/09\/CA-AG-Bonta-v-NJ-AG-Platkin-Soon.jpg\" target=\"_blank\" rel=\"noopener\">their accusations<\/a> from Sher Edling filings). As I showed <a href=\"http:\/\/gelbspanfiles.com\/?p=10896\" target=\"_blank\" rel=\"noopener\">in my Oct 2020 dissection<\/a> of Sher Edling&#8217;s <em>Delaware v BP<\/em> filing and re-emphasized in <a href=\"http:\/\/gelbspanfiles.com\/?p=17994\" target=\"_blank\" rel=\"noopener\">my Jan 10 post<\/a>, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/Sher-Edling-v-Soon-sorta-Baliunas.jpg\" target=\"_blank\" rel=\"noopener\">their pattern was to accuse<\/a> <strong>1)<\/strong> the fossil fuel industry of &#8220;bankrolling&#8221; &#8216;fringe&#8217; scientists; <strong>2)<\/strong> say &#8216;fringe scientists&#8217; go funding from fossil fuel companies; and <strong>3)<\/strong> say these scientists failed to disclose the funding. What&#8217;s Sher Edling&#8217;s cited source for the &#8216;fringe scientists&#8217; slur? A 2003 paper by Soon <strong><em>and<\/em><\/strong> Baliunas. What&#8217;s Sher Edling&#8217;s cited source for the &#8216;failure to disclose&#8217; accusation? The Smithsonian Institution&#8217;s <a href=\"https:\/\/web.archive.org\/web\/20200304150123\/https:\/\/www.si.edu\/newsdesk\/releases\/smithsonian-statement-dr-wei-hock-willie-soon\" target=\"_blank\" rel=\"noopener\">2015 press release<\/a> (taken offline at some point <a href=\"https:\/\/web.archive.org\/web\/20200901150041\/https:\/\/www.si.edu\/newsdesk\/releases\/smithsonian-statement-dr-wei-hock-willie-soon\" target=\"_blank\" rel=\"noopener\">after March 4 2020<\/a>) which only notes that it was beginning its inquiry into Dr Soon&#8217;s funding disclosures situation \u2026.. and which <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/01\/SI-v-Soon-Mar-2020.jpg\" target=\"_blank\" rel=\"noopener\"><strong>never mentions<\/strong> Dr Baliunas&#8217; name at all<\/a>.<\/p>\n<p>Why did the Smithsonian not also say it was investigating Dr Baliunas&#8217; funding disclosures?<\/p>\n<p>Is it a pure coincidence that in the summer of 2011 within a Seattle KXEP public radio interview of Naomi Oreskes, she spoke of Dr Soon as being the replacement for the &#8216;old generation&#8217; of &#8216;industry-paid climate deniers&#8217; <a href=\"https:\/\/www.youtube.com\/watch?v=jOnXL8ob_js&amp;t=1457s\" target=\"_blank\" rel=\"noopener\">and then said<\/a> &#8211; without skipping a beat &#8211; &#8220;<em>just a couple of days ago a big report was released by Greenpeace about his funding and evidently according to Greenpeace, he&#8217;s received over a million dollars of funding from the fossil fuel industry<\/em>\u2026&#8221;<\/p>\n<p>No mention there whatsoever that Davies&#8217; own report said &#8211; irrespective of who received whatever funding &#8211; that it was across the time span of a decade \u2026 and no mention of Dr Baliunas at all.<\/p>\n<p>What&#8217;s up with her failure to tell the whole story there? What&#8217;s up with <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/12\/Milberg-bankroll-sci.jpg\" target=\"_blank\" rel=\"noopener\">other law firms<\/a> &#8211; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/08\/Multnomah-Soon-bankroll.jpg\" target=\"_blank\" rel=\"noopener\">plural<\/a> &#8211; deciding to substitute <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/09\/CA-v-Soon.jpg\" target=\"_blank\" rel=\"noopener\">alternative citation sources<\/a> for the 2015 Smithsonian press release?<\/p>\n<p>See the overarching problem here?
