{"id":10455,"date":"2020-07-07T16:04:48","date_gmt":"2020-07-07T23:04:48","guid":{"rendered":"http:\/\/gelbspanfiles.com\/?p=10455"},"modified":"2024-10-12T08:20:59","modified_gmt":"2024-10-12T15:20:59","slug":"d-c-v-exxonmobil-et-al-pt-2-the-17000-scientists-source-problem","status":"publish","type":"post","link":"https:\/\/gelbspanfiles.com\/?p=10455","title":{"rendered":"<i>D.C. v ExxonMobil, et. al<\/i> Pt 2: the &#8220;17,000 Scientists&#8221; Source Problem"},"content":{"rendered":"<p>It doesn&#8217;t take more than a few seconds of internet searching to discover how the Oregon Petition Project had <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/31k-Goog-768x1143.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">over 31,000 signers<\/a>, corroborated not only at the <a href=\"http:\/\/www.petitionproject.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Home Page<\/a> of the website for the petition itself, but also at sites highly biased against it <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Wikiped-Oregon.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">such as Wikipedia<\/a> and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Desmog-Oregon.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Desmogblog<\/a> (<em>that<\/em> <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/01\/Hoggan-know-nothing-liars.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Desmog<\/a>). But as I showed <a href=\"http:\/\/gelbspanfiles.com\/?p=10409\" target=\"_blank\" rel=\"noopener noreferrer\">in my Part 1 dissection<\/a> of that lawsuit, the District of Columbia Attorney General Karl Racine&#8217;s lawsuit only placed the number at 17,000, with no citation source for that number.<\/p>\n<p><img loading=\"lazy\" class=\"\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/DC-v-Exxon-17000.jpg\" width=\"512\" height=\"191\" \/><\/p>\n<p>Where could that hugely outdated figure originate?\u00a0 <!--more--><\/p>\n<p>At the end of my Part 1 post, I suggested that maybe a hapless intern simply relied on <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/06\/ClimFiles-17k-signers.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">a document<\/a> from <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Davies-CIC-ClimFiles-founder.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Kert Davies&#8217; Climate Files site<\/a>, since he&#8217;s already seen as a source that other global warming lawsuit handlers cite. A bit farther up in that post, I offered a screencapture of a <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/03\/Passac-NYT-Honeycutt.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">1998 letter to the <em>New York Times<\/em><\/a> containing that 17,000 signatories figure written by his <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/08\/OA-staff-Passac-Davies2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">long-ago boss<\/a>, the same person seen more recently as a fellow apparently <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/05\/Davies-Passac-suspects.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">anti-Exxon effort collaborator<\/a> and funneler of <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/02\/Walrath-CIC-dark-money.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">mega-dollars<\/a>.<\/p>\n<p>There&#8217;s one other particularly distinct source, one that I had forgotten about. It doesn&#8217;t look good for District of Columbia Attorney General Karl Racine, and only leads to more questions than answers on how distinctive shared wording ends up in these kinds of lawsuits.<\/p>\n<p>In a chance correspondence with a candidate who&#8217;d just won her June 30 Colorado primary election, I alerted her to the potential leadership opportunity of questioning the jointly filed 2018 <em>Boulder City\/County<\/em> \/ <em>San Miguel County v. Suncor Energy, Exxon<\/em> lawsuits, and in re-reading my own <a href=\"http:\/\/gelbspanfiles.com\/?p=6699\" target=\"_blank\" rel=\"noopener noreferrer\">dissection of those<\/a>, the dead wrong &#8220;17,000 scientists&#8221; figure is seen in that trio of filings, in an almost <strong>word-for-word version<\/strong> of the passage now in the <em>D.C.<\/em> lawsuit.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/DC-text-from-Boulder.jpg\" \/><\/p>\n<p>Drop those two passages into the <a href=\"https:\/\/www.diffnow.com\/compare-clips\" target=\"_blank\" rel=\"noopener noreferrer\">DiffNow site&#8217;s comparator<\/a>, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/fc9fdc68-5d04-4933-8fa4-56602d3912d3.html\" target=\"_blank\" rel=\"noopener noreferrer\">it&#8217;ll show<\/a> what I highlight above. The writers of the <em>D.C.<\/em> lawsuit seemingly lifted that whole passage out of the <em>Boulder<\/em> trio, dropped the turquoise-highlighted #399 paragraph in favor of the words &#8220;<em>by questioning mainstream scientific conclusions<\/em>&#8221; while adding a three-dot ellipsis and making the other very minor changes I highlight in purple.<\/p>\n<p>Neither the <em>D.C.<\/em> lawsuit nor the <em>Boulder<\/em> trio provide any citation sources for their incorrect &#8220;17,000 scientists&#8221; figure or any of their other claims. Lawsuits do regularly cite prior lawsuits, no harm there when they make the effort to attribute the sources properly. At a rock bottom minimum, this looks like the sloppy work of a legal intern, perhaps too lazy to independently come to this conclusion or to at least reword the passage much more effectively to disguise where it came from.<\/p>\n<p>Since the <em>Boulder<\/em> trio got the &#8220;17,000 scientists&#8221; figure spectacularly wrong, I offered some speculation in my dissection of that trio about its origins. One possibility is yet another global warming lawsuit, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/04\/CO-vs-Kiv-Oregon-petition-1024x625.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the 2008 <em>Kivalina v Exxon<\/em> one<\/a> led by attorney Matt Pawa. What was Pawa&#8217;s source for the &#8220;17,000 scientists&#8221; figure? To his credit, he first noted that the figure was spoken in 2000 by then-CEO of Exxon, Lee Raymond. In rebuttal, Pawa first offered the following from an April 1998 <em>New York Times<\/em> report, which has wording looking similar to what appears in the days-old <em>D.C.<\/em> lawsuit \u2014 with one glaring exception:<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Kiv-DC-article-v-petition-1024x612.jpg\" \/><\/p>\n<p>The <em>NYT<\/em> report,<strong>*<\/strong> actually dating from April 26, states that the National Academy of Sciences objected to the format of <strong>an article<\/strong> accompanying the petition that supposedly looked like NAS articles, not the format of the petition. (<strong>*<\/strong><em>NYT<\/em>&#8216;s report itself <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/NYT-98-NAS-dis-article.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">only mentions the petition briefly<\/a>, and the rest of it concerns an unnamed leaked industry memo, which has <a href=\"http:\/\/gelbspanfiles.com\/?p=8159\" target=\"_blank\" rel=\"noopener noreferrer\">huge problems concerning who first discovered it<\/a>).<\/p>\n<p>Pawa&#8217;s old <em>Kivalina v Exxon<\/em> also had a source, immediately after its bit on the &#8220;17,000 scientists,&#8221; regarding the &#8216;fictitious names .. and celebrities&#8217; that the <em>D.C.<\/em> lawsuit alludes to. Pawa&#8217;s source for that is a May 1998 Associated Press article:<\/p>\n<p><img loading=\"lazy\" class=\"\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Kiv-celebrities.jpg\" width=\"528\" height=\"243\" \/><\/p>\n<p>The AP article, actually dating from a day earlier, is a little more specific on the &#8216;names&#8217; \u2026.. and who &#8216;discovered&#8217; them.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/AP-Passacs-OA.jpg\" \/><\/p>\n<p>I must remind everyone that <a href=\"http:\/\/gelbspanfiles.com\/?p=3765\" target=\"_blank\" rel=\"noopener noreferrer\">my March 29, 2016 blog post<\/a> detailed how it turns out there was only pure supposition beyond one fake name in the petition. But does the wording in the Associated Press article look familiar? Have a look again at the screencapture I had near the top this post of the 1998 letter to the <em>New York Times<\/em>, only now let&#8217;s all look at it with key words highlighted:<\/p>\n<p><img loading=\"lazy\" class=\"\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/07\/Passac-NYT-letter-highlight.jpg\" width=\"519\" height=\"679\" \/><\/p>\n<p>Yes, once again, this is <strong><em>that<\/em><\/strong> John Passacantando of Ozone Action, the <span style=\"color: #ff0000;\">same<\/span> little group that gave the <a href=\"http:\/\/gelbspanfiles.com\/?p=7477\" target=\"_blank\" rel=\"noopener noreferrer\">worthless<\/a> &#8220;reposition global warming&#8221; &#8216;leaked memos&#8217; their first major media traction after he and Ross Gelbspan magically <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/10\/OA-Gelb-obtained-v2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">&#8216;obtained&#8217; those memos<\/a>, which were used by global warming lawsuits <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/Pawa-Kiv-ICE-API.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">like <em>Kivalina v Exxon<\/em><\/a> and the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/06\/MN-v-API-reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">days-old <em>Minnesota vs. API, Exxon<\/em><\/a>, but oddly <em>not<\/em> in ones like <em>D.C. v Exxon<\/em>; the <span style=\"color: #ff0000;\">same<\/span> Passacantando whose major associate at Ozone Action <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/08\/OA-staff-Passac-Davies2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">was Kert Davies<\/a>, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2014\/08\/Davies-GP-ExxonSecrets.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">at Greenpeace<\/a> after Passacantando <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/02\/GP-nee-OA-874x1024.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">merged Ozone Action into it<\/a>; the <span style=\"color: #ff0000;\">same<\/span> Greenpeace that <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/01\/GP-DiD-API-2010-leaked-to.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">trumpeted its role<\/a> of receiving the (<a href=\"http:\/\/gelbspanfiles.com\/?p=8211\" target=\"_blank\" rel=\"noopener noreferrer\">worthless<\/a>) &#8216;leaked&#8217; API &#8220;victory will be achieved\u2026&#8221; memos, which were also used by global warming lawsuits <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/Pawa-Kiv-ICE-API.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">like <em>Kivalina v Exxon<\/em><\/a> and <strong><em>are<\/em><\/strong> used the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/06\/DC-v-Exxon-Victory.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">days-old <em>D.C. v Exxon<\/em> one<\/a>; the <span style=\"color: #ff0000;\">same<\/span> Kert Davies whose <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/CIC-Davies-ClimFiles.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Climate Investigations Center&#8217;s Climate Files &#8216;platform&#8217;<\/a> is used <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/10\/Sher-Edlings-Chicken.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">by the Sher Edling law firm<\/a> that&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/Sher-Edling-official-filing.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">handling the <em>Honolulu v Sunoco, Exxon<\/em> lawsuit<\/a> and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/Sher-Edling-2-not-Honolulu.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">nine other identical ones<\/a>; the <span style=\"color: #ff0000;\">same<\/span> Sher Edling law firm that&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/06\/Sher-Edling-for-DC-AG.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">lending a hand<\/a> to this <em>D.C.<\/em> lawsuit; \u2026\u2026.<\/p>\n<p>\u2026. and to repeat from the second paragraph at the top of this post, the <span style=\"color: #ff0000;\">same<\/span> John Passacantando recently partnered up with Davies <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/05\/Davies-Passac-suspects.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">in efforts to portray Exxon as a corrupt organization<\/a>; the <span style=\"color: #ff0000;\">same<\/span> Passacantando apparently revealed to be funneling mega-dollars, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/02\/Walrath-CIC-dark-money.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">nearly five million if not more lately<\/a>, into Davies&#8217; CIC organization.<\/p>\n<p>No matter how these &#8216;<em>Exxon and other oil companies funded\/orchestrated disinformation campaigns<\/em>&#8216; lawsuits show up, they end up in the same circles around worthless &#8216;leaked memos&#8217; evidence pushed by the same tiny circles of associated promulgators.<\/p>\n<p>How did the faulty &#8220;17,000 scientists&#8221; figure actually end up in this <em>D.C. v Exxon<\/em> lawsuit?<\/p>\n<p>Does nearly five million dollars also purchase efforts to ensure the worthless old insinuation of &#8216;uncountable numbers of fake names&#8217; in the Oregon Petition Project get inserted into the latest global warming lawsuits?<\/p>\n<p>Examiners with far more investigative resources and power than I have will be able to get to the bottom of this.
