{"id":6864,"date":"2018-05-25T13:19:38","date_gmt":"2018-05-25T20:19:38","guid":{"rendered":"http:\/\/gelbspanfiles.com\/?p=6864"},"modified":"2018-12-10T10:45:42","modified_gmt":"2018-12-10T17:45:42","slug":"pawas-pro-anti-gelbspan-weirdness","status":"publish","type":"post","link":"http:\/\/gelbspanfiles.com\/?p=6864","title":{"rendered":"Pawa&#8217;s pro-\/anti-Gelbspan Weirdness"},"content":{"rendered":"<p>That&#8217;s <em>Matt<\/em> Pawa, who&#8217;s increasingly gaining fame as <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Pawa-AGW-cases-1024x628.jpg\" target=\"_blank\" rel=\"noopener\">the leader of four current global warming lawsuits<\/a>, and who was described in a December 2017 <em>Huffington Post<\/em> article as <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/06\/HuffPo-Pawa-brains.jpg\" target=\"_blank\" rel=\"noopener\">the main driver behind such legal action<\/a>. &#8220;Wierdness&#8221;, because there is much about Pawa&#8217;s manner of establishing how &#8216;fossil fuel companies conspired with skeptic climate scientists to hide the harm of man-caused global warming&#8217; in his <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Kiv-Landmark-case.jpg\" target=\"_blank\" rel=\"noopener\">landmark 2008 <em>Kivalina v. Exxon<\/em> lawsuit<\/a> which makes no sense. And &#8220;Gelbspan&#8221; is the person who&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Gelb-we-published.jpg\" target=\"_blank\" rel=\"noopener\">self-described<\/a> as the first one to reveal that conspiracy.<\/p>\n<p>What&#8217;s weird here is how Pawa can&#8217;t bring himself to give Gelbspan that direct accolade to this day, regarding Gelbspan&#8217;s evidence which appears plausible enough to nail fossil fuel companies to the wall for the whole world to see.<!--more--><\/p>\n<p>By early 2008, when Pawa finished assembling his <em>Kivalina<\/em> case and was ready to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/01\/Pawa-KivComplaint.jpg\" target=\"_blank\" rel=\"noopener\">file it in court<\/a>, Ross Gelbspan was near the pinnacle of his fame as a someone who unmasked a sinister corporate conspiracy, revered by people ranging from <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Gelb-Pulit-WaPo-07.jpg\" target=\"_blank\" rel=\"noopener\">anonymous commenters<\/a> at <em>Washington Post<\/em> Fact Checker articles, to major <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2014\/03\/Hertzgaard-VF-reposit-1024x417.jpg\" target=\"_blank\" rel=\"noopener\">magazine article writers<\/a>, and even to Vice President <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/06\/AnIncT-Reposit-Doubt.jpg\" target=\"_blank\" rel=\"noopener\">Al Gore<\/a>, whose companion book for his 2006 documentary movie proclaimed in regard to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2013\/06\/AnIncT-263.jpg\" target=\"_blank\" rel=\"noopener\">sinister fossil fuel industry efforts<\/a>,<\/p>\n<blockquote><p>One of the internal memos prepared by this group to guide the employees they hired to run their disinformation campaign was <span style=\"color: #ff0000;\">discovered by the Pulitzer Prize-winning reporter Ross Gelbspan<\/span>. Here was the group&#8217;s stated objective: to &#8220;<strong>reposition global warming as theory, rather than fact<\/strong>.&#8221;<\/p><\/blockquote>\n<p>And there&#8217;s no way to miss what Gelbspan himself implied about <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Gelb-Frontline-HotPol.jpg\" target=\"_blank\" rel=\"noopener\">his role<\/a> in this revelation in the April 2007 Frontline &#8220;<a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/film\/hotpolitics\/\" target=\"_blank\" rel=\"noopener\">Hot Politics<\/a>&#8221; national broadcast. Perhaps Matt Pawa, who had already earned the label &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Mooney-Pawa-AGWlitg-06.jpg\" target=\"_blank\" rel=\"noopener\">global warming litigator<\/a>&#8221; by 2006, was impressed enough with all of this behind the &#8220;<em>reposition global warming<\/em>&#8221; leaked memos to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Kiv-reposit-2.jpg\" target=\"_blank\" rel=\"noopener\">include them<\/a> in his 2008 <em>Kivalina<\/em> case, and was apparently impressed enough with Gelbspan&#8217;s work to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/04\/Kiv-Gelb-Nation-article.jpg\" target=\"_blank\" rel=\"noopener\">cite him directly<\/a> in that lawsuit.<\/p>\n<p>But Pawa seemed to bend over backwards <em>not<\/em> to directly credit Gelbspan with anything relating to those leaked memos.<\/p>\n<p>That&#8217;s weird. Or it it?<\/p>\n<p>As I showed in <a href=\"http:\/\/gelbspanfiles.com\/?p=6805\" target=\"_blank\" rel=\"noopener\">my prior blog post<\/a>, Matt Pawa seems to indicate a good familiarity with Gelbspan in his current <em>King County v. BP<\/em> global warming lawsuit, as seen in a citation reference to an article copy <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/King-CO-Nesmith-HiO.jpg\" target=\"_blank\" rel=\"noopener\">at Gelbspan&#8217;s HeatIsOnline website<\/a>. But the elemental question is, what does Pawa know about both Gelbspan&#8217;s &#8216;crooked skeptics&#8217; accusation in combination with those <a href=\"http:\/\/gelbspanfiles.com\/?p=4024\" target=\"_blank\" rel=\"noopener\">worthless<\/a> leaked &#8220;reposition global warming&#8221; memo set, and when did he know all of it? SourceWatch <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/SourceW-HiO-SEPP.jpg\" target=\"_blank\" rel=\"noopener\">cites Ross Gelbspan&#8217;s HeatIsOnline website<\/a>. Pawa could have skipped the middleman and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/HiO-SEPP-Nightline.jpg\" target=\"_blank\" rel=\"noopener\">cited Gelbspan directly<\/a>.<\/p>\n<p style=\"padding-left: 30px;\">This isn&#8217;t the first time in the <em>Kivalina<\/em> case when Matt Pawa could have skipped a Rampton citation and cited Gelbspan directly instead. But hold onto that thought for a few moments.<\/p>\n<p><strong>2.<\/strong> In his 1\/1\/2006 &#8220;Behind The Curve: The National Media&#8217;s Reporting on Global Warming&#8221; <a href=\"http:\/\/lawdigitalcommons.bc.edu\/cgi\/viewcontent.cgi?article=1096&amp;context=ealr\" target=\"_blank\" rel=\"noopener\">27-page paper<\/a> concerning the viability of global warming lawsuits, Matt Pawa displayed a very good understanding of Gelbspan&#8217;s viewpoints about the unnecessary requirement to give skeptic climate scientists &#8216;fair media balance&#8217; &#8212; not just <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-Gelb-867x1024.jpg\" target=\"_blank\" rel=\"noopener\">once<\/a>, but <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-Gelb2.jpg\" target=\"_blank\" rel=\"noopener\">twice<\/a>.<\/p>\n<p><strong>3.<\/strong> Pawa further shows his familiarity with Gelbspan&#8217;s HeatIsOnline website in the 2006 &#8220;Behind the Curve&#8221; paper by noting how a particular <em>Wall Street Journal<\/em> article can be read <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-HiO-828x1024.jpg\" target=\"_blank\" rel=\"noopener\">at Gelbspan&#8217;s site<\/a> \u2026 despite how the article has always been available <a href=\"https:\/\/www.wsj.com\/articles\/SB110834031507653590\" target=\"_blank\" rel=\"noopener\">directly at the <em>WSJ<\/em> <\/a>to this very day.<\/p>\n<p>Point being, Ross Gelbspan&#8217;s overall notoriety isn&#8217;t unfamiliar to Matt Pawa, thus he is not likely to have never heard of what Gelbspan <a href=\"https:\/\/www.google.com\/search?q=%22The+heat+is+on%22+%22reposition+global+warming%22+-gelbspanfiles\" target=\"_blank\" rel=\"noopener\">is most famous for<\/a>, his so-called discovery of that leaked &#8220;reposition global warming&#8221; \/ &#8220;older, less-educated men&#8221; \/ &#8220;young, low-income women&#8221; strategy\/targeting memo set. The weird thing here is how Pawa seemingly chooses never to mention them in direct connection to Gelbspan.<\/p>\n<p>Let&#8217;s go one increment further on this &#8216;leaked memo&#8217; angle with Pawa&#8217;s Fall 2005 lengthy paper about the viability of future global warming lawsuits, &#8220;<a href=\"http:\/\/www.jstor.org\/stable\/44174873?seq=1#page_scan_tab_contents\" target=\"_blank\" rel=\"noopener\">Global Warming as a Public Nuisance: Connecticut v. American Electric Power<\/a>&#8221; and then work our way forward.<\/p>\n<p><strong>1.<\/strong> Despite the sheer length of his 2005 paper, Pawa only devotes partial paragraph <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Pawa-05-reposit.jpg\" target=\"_blank\" rel=\"noopener\">footnote space<\/a> to the topic of misinformation being spread by the fossil fuel industry:<\/p>\n<blockquote><p>\u2026 The perception of a divided scientific community is largely the product of a long and sophisticated industry public relations campaign to mislead the public \u2026 See, e.g., &#8230; Mary O&#8217;Driscoll, Greenhouse Ads Target <strong>Low-Income&#8217; Women, &#8216;Less-Educated&#8217; Men<\/strong>, THE ENERGY DAILY, June 24, 1991; Matthew L. Wald, Pro-Coal Campaign Disputes Warming Idea, N.Y. TIMES, July 8, 1991 .. (<span style=\"color: #ff0000;\">EEl helped organize<\/span> a campaign to &#8220;&#8216;<strong>reposition global warming as theory (not fact)<\/strong>.&#8221;&#8216;)<\/p><\/blockquote>\n<p style=\"padding-left: 30px;\">&#8220;EEI helped organize&#8221;?? That isn&#8217;t what the most prominent publication said at the time, Ross Gelbspan&#8217;s 2004 &#8220;Boiling Point&#8221; hardcover\/2005 paperback, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BP-WFA-04-Strat-Target.jpg\" target=\"_blank\" rel=\"noopener\">about those memos<\/a>. But as I detailed with corroboration in my <a href=\"http:\/\/gelbspanfiles.com\/?p=4024\" target=\"_blank\" rel=\"noopener\">June 7, 2016 blog post<\/a>, those memos were a <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/10\/Arnold-corroborates.jpg\" target=\"_blank\" rel=\"noopener\">rejected proposal<\/a> from EEI to the Western Fuels &#8220;Information Council for the Environment&#8221; (ICE) public relations campaign, and thus those &#8216;strategy\/targeting&#8217; goals were never used in the ICE campaign, nor did EEI organize and implement any such strategy\/targeting&#8217; goals.<\/p>\n<p><strong>2.<\/strong> When continuing on the theme of an irresponsible media in his 2006 &#8220;Behind The Curve&#8221; paper, Pawa went into <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-misled-media.jpg\" target=\"_blank\" rel=\"noopener\">more speculation<\/a> about &#8216;misinformation campaigns&#8217;:<\/p>\n<blockquote><p>Why is the press missing the boat so badly on global warming? The perception of a divided scientific community is largely the product of a long and sophisticated public relations campaign by the electric power, coal, oil, and automobile industries to mislead the public \u2026 through the use of industry-funded &#8220;skeptics.&#8221; \u2026<\/p>\n<p>\u2026 The use of industry-funded &#8220;skeptics&#8221; to cast doubt on the science seems to have succeeded in fooling many journalists who report on global warming\u2014even <span style=\"color: #ff0000;\">as a subset of those journalists have unmasked this effort<\/span>.<\/p><\/blockquote>\n<p>Which journalists did Pawa credit with this &#8220;unmasking?&#8221; Not his <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-Gelb-867x1024.jpg\" target=\"_blank\" rel=\"noopener\">aforementioned journalist<\/a> Gelbspan, but instead a <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/BtCurve-Strat-Target.jpg\" target=\"_blank\" rel=\"noopener\">variation of the list<\/a> from the 2005 paper.<\/p>\n<p><strong>3.<\/strong> As I&#8217;ve shown several times in my blog posts here, Pawa indicated that those leaked strategy\/targeting memo phrases were incriminating enough that he prominently <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Kiv-Strat-Target.jpg\" target=\"_blank\" rel=\"noopener\">cited them<\/a> in his 2008 <em>Kivalina<\/em> case. Prominently enough that it <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/02\/USNWP-Pawa-Kiv-reposit.jpg\" target=\"_blank\" rel=\"noopener\">caught the attention<\/a> of <em>US News &amp; World Report<\/em>. But who was his <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/02\/KivVExx-reposit-source.jpg\" target=\"_blank\" rel=\"noopener\">footnote #64 source<\/a> for the people who &#8216;exposed&#8217; these memos?<\/p>\n<blockquote><p>Bob Burton &amp; <span style=\"color: #ff0000;\">Sheldon Rampton<\/span>, Thinking Globally, Acting Locally: The International Conspiracy to Overheat the Earth, PR Watch Newsletter, 1997,<br \/>\nhttp:\/\/www.prwatch.org\/prwissues\/1997Q4\/warming.html; Mathew Wald, Pro-Coal Ad Campaign Disputes Warming Idea, N.Y. Times, July 8, 1991<\/p><\/blockquote>\n<p>There&#8217;s that Rampton name again. Remember what I said above about &#8220;<em>Matt Pawa could have skipped a Rampton citation and cited Gelbspan directly<\/em>\u201d? Watch this:<\/p>\n<p>The Burton-Rampton article version that Pawa might have accessed during the assembly of his <em>Kivalina<\/em> case does indeed contain the assertion seen in Pawa&#8217;s paragraph about one of the scientists disassociating from the ICE campaign. But it also <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Pawas-Rampton-07-1024x650.jpg\" target=\"_blank\" rel=\"noopener\">says the following<\/a>:<\/p>\n<blockquote><p>\u2026 a U.S. corporate coalition including the National Coal Association, the Western Fuels Association and Edison Electrical Institute created a PR front group called the &#8220;Information Council for the Environment&#8221; (ICE) \u2026 in a campaign to, in ICE&#8217;s own words, &#8220;<strong>reposition global warming as theory (not fact)<\/strong>.&#8221; \u2026<\/p>\n<p>\u2026 The ICE was run by Bracy Williams &amp; Co., a Washington-based P.R. firm. Using opinion polling, it identified &#8220;<strong>older, less-educated males<\/strong> from larger households who are not typically active information-seekers&#8221; and &#8220;<strong>younger, lower-income women<\/strong>&#8221; as &#8220;good targets for radio advertisements&#8221; \u2026<\/p><\/blockquote>\n<p>Now we have the ICE campaign being run by some PR firm instead of by Western Fuels. But who is Burton-Rampton&#8217;s source? They don&#8217;t have footnotes like lawsuits do, but at the end of their article, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Rampton-07-CLEAR-Gelb-Beder.jpg\" target=\"_blank\" rel=\"noopener\">it says<\/a>:<\/p>\n<blockquote><p>Part of the information for this story was provided by the Clearinghouse on Environmental Advocacy and Research (CLEAR); by Ross Gelbspan, author of The Heat Is On; and by Sharon Beder, author of Global Spin: the Corporate Assault on Environmentalism.<\/p><\/blockquote>\n<p>Take each one of those sources in turn &#8211; CLEAR cites <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2013\/10\/Clear-reposit-phrase-1024x442.jpg\" target=\"_blank\" rel=\"noopener\">Gelbspan and the old Ozone Action organization<\/a>\u2019s &#8220;Ties that Blind&#8221; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/10\/OA-Gelb-obtained-v2.jpg\" target=\"_blank\" rel=\"noopener\">report<\/a> for the source of those strategy\/targeting phrases (Ozone Action never said where <strong><em>they<\/em><\/strong> &#8216;obtained&#8217; those memos); Gelbspan <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/03\/THio-pg-34.jpg\" target=\"_blank\" rel=\"noopener\">cites<\/a> \u2026 well, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/01\/Gelb-ICE-docs-1024x623.jpg\" target=\"_blank\" rel=\"noopener\">himself<\/a>, without saying where <strong><em>he<\/em><\/strong> got them; and Sharon Beder only <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Beder-OA.jpg\" target=\"_blank\" rel=\"noopener\">cites Ozone Action<\/a> &#8211; or more specifically, the same Ozone Action <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Beder-OA-TiesBlind.jpg\" target=\"_blank\" rel=\"noopener\">&#8220;Ties that Blind&#8221; report<\/a> which CLEAR cites.<\/p>\n<p>If all that convoluted effort to avoid directly citing Ross Gelbspan as the source for those worthless leaked memos wasn&#8217;t weird enough, Matt Pawa made his situation one step incrementally weirder by citing <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/05\/Kiv-Matt-Wald.jpg\" target=\"_blank\" rel=\"noopener\">Mathew Wald&#8217;s <em>NYT<\/em> article<\/a> for them.
