BP P.L.C., et al<\/a>&#8221; blog post. The <em>People of the State of California v. BP P.L.C., et al.<\/em> San Francisco Superior Court Case is the other one; both are basically identical. Within that post toward the end, I <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/GF-State-of-CA-Singer.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">briefly described<\/a> what was suspect about a <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/09\/CA-v-BP-attack-mainstream-science.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">particular line in the lawsuits<\/a>, regarding Science and Environment Public Policy <a href=\"https:\/\/www.heartland.org\/about-us\/who-we-are\/s-fred-singer\" target=\"_blank\" rel=\"noopener noreferrer\">(SEPP) founder Dr S Fred Singer<\/a>. Since the news over the weekend concerned SEPP&#8217;s mention of &#8220;slander,&#8221; I thought it would be worthwhile to show why it is that SEPP would say such a thing.<!--more--><\/p>\n<p>First, for those unaware of it, SEPP puts out a weekly &#8220;<a href=\"http:\/\/sepp.org\/the-week-that-was.cfm\" target=\"_blank\" rel=\"noopener noreferrer\">The Week That Was<\/a>&#8221; global warming news round-up, and their week of <a href=\"http:\/\/sepp.org\/twtwfiles\/2018\/TWTW%203-10-18.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">March 10, 2018<\/a> included a &#8220;Standards of Evidence&#8221; item featuring a list of &#8216;tutorial&#8217; questions the presiding judge of the Oakland case was asking for, regarding largely science material &#8211; screencapture <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Presiding-judge.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a> for easier finding within SEPP&#8217;s pages. Below that list, SEPP quoted two paragraphs from the Oakland case and voiced its concerns about slander:<\/p>\n<p><a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander.jpg\"><img loading=\"lazy\" class=\"size-medium wp-image-6472 alignleft\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander-300x254.jpg\" alt=\"\" width=\"300\" height=\"254\" srcset=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander-300x254.jpg 300w, http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander-768x649.jpg 768w, http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander-355x300.jpg 355w, http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oakland-slander.jpg 900w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<blockquote><p>\u2026<span style=\"color: #ff0000;\">Exxon in particular has paid researchers and front groups to create uncertainties<\/span> about basic climate change science <strong>and used denialist groups to attack well-respected scientists<\/strong>\u2026<\/p>\n<p>Between 1998 and 2014, <span style=\"color: #ff0000;\">Exxon paid millions of dollars to organizations to promote disinformation on global warming<\/span>. During the early- to mid-1990s, <strong>Exxon directed some of this funding to <\/strong>Dr. Fred Seitz, <strong>Dr. Fred Singer, <\/strong>and\/or Seitz<strong> and Singer&#8217;s Science and Environmental Policy Project (&#8220;SEPP&#8221;) in order to launch <span style=\"color: #ff0000;\">repeated attacks on mainstream climate science<\/span><\/strong> and IPCC conclusions, even as Exxon scientists participated in the IPCC. Seitz, <span style=\"color: #ff0000;\">Singer and SEPP had previously been paid by the tobacco industry to create doubt in the public mind about the hazards of smoking<\/span>\u2026.<\/p>\n<p>SEPP is exploring if, as a party possibly slandered in the City of Oakland complaint, can it file an amicus (friend in court) brief in the case. If so, such a brief would probably focus on the standards of evidence: Direct or Indirect; Physical <strong>or Bureaucratic<\/strong>.<\/p><\/blockquote>\n<p>Basically, the lawsuits imply lies\/misinformation about the otherwise certain harm of smoking and man-caused global warming could be bought from Dr Singer. This same insinuation is found within Matt Pawa&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/01\/HBlaw-NYC-Pawa.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><em>New York v. BP<\/em><\/a> lawsuit <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/NYCvBP-SEPP.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">at its page 46<\/a>. Pawa is the prominent attorney leading the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/01\/HBlaw-CA-state-Pawa.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">San Francisco \/ Oakland cases<\/a>.<\/p>\n<p>The question is, when it comes to Pawa&#8217;s preparation for the cases and who he relied on for his supposedly incriminating material, do they maliciously push the material while knowing it is false? Or is the overall insinuation\/corruption accusation simply an example of hugely inept fact-checking?<\/p>\n<p>It isn&#8217;t a matter of rocket science to find out whether Dr Singer ever said smoking wasn&#8217;t harmful, or whether the bit about receiving money in exchange for issuing global warming misinformation holds water.<\/p>\n<p>Concerning the &#8220;<em>paid by the tobacco industry<\/em>&#8221; line, I detailed in my <a href=\"http:\/\/gelbspanfiles.com\/?p=5176\" target=\"_blank\" rel=\"noopener noreferrer\">May 6, 2017 blog post<\/a> how that accusation essentially stems from <a href=\"https:\/\/www.desmogblog.com\/no-apology-is-owed-dr-s-fred-singer-and-none-will-be-forthcoming\" target=\"_blank\" rel=\"noopener noreferrer\">a single source<\/a>, Desmogblog, which apparently never read <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/05\/pg6.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">their own source of evidence<\/a>. On top of that, Dr Singer has <a href=\"https:\/\/www.americanthinker.com\/articles\/2010\/12\/second_hand_smoke_lung_cancer.html\" target=\"_blank\" rel=\"noopener noreferrer\">clearly stated<\/a> his <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Singer-AT-ETS.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">anti-smoking position<\/a>. It stands to reason that if he said second-hand smoke &#8220;<em>cannot possibly be healthy<\/em>&#8221; then by default it&#8217;s illogical to imply he would say there&#8217;s doubt about the harm of smoking.<\/p>\n<p>On the &#8216;<em>Exxon paid to promote disinformation \/ directed funding to SEPP to<strong> attack mainstream climate science \/ scientists<\/strong><\/em>\u2019 line, I posit that there is only one single source for that accusation as well. Listen to both <a href=\"https:\/\/www.youtube.com\/watch?v=I1Do9vut6tc&amp;t=1748s\" target=\"_blank\" rel=\"noopener noreferrer\">Al Gore<\/a> \u2026<\/p>\n<blockquote><p>Exxon Mobil has funded 40 different front groups that have all been a part of a strategic persuasion campaign to, in their own words &#8220;<span style=\"color: #ff0000;\">reposition global warming as theory rather than fact<\/span>.&#8221;<\/p><\/blockquote>\n<p>\u2026 and <a href=\"https:\/\/www.youtube.com\/watch?v=FnF_AFnGW3Q&amp;t=658\" target=\"_blank\" rel=\"noopener noreferrer\">Ross Gelbspan<\/a>:<\/p>\n<blockquote><p>Western Fuels, which is a 400 million dollar coal operation, it was very candid in its annual report. It said <strong>it was out to attack mainstream scientists<\/strong>, it hired three scientists who were skeptical of this, phenomenon, Pat Michaels, Bob Balling, <strong>Fred Singer<\/strong>. It turned out they paid these three scientists more than a million dollars under the table \u2026 We got a copy of the strategy papers for that campaign. And it says specifically that the campaign is designed to &#8220;<span style=\"color: #ff0000;\">reposition global warming as theory rather than fact<\/span>&#8221; \u2026.<\/p><\/blockquote>\n<p>Dig deep enough in the &#8216;crooked skeptics&#8217; accusation, and you ultimately discover that in regard to the notion about skeptics being in a pay-for-performance arrangement with anybody in the fossil fuel industry, there&#8217;s <strong>only one<\/strong> usable weapon in the enviro-activists&#8217; arsenal to indict those skeptics as industry-paid shills: the supposedly leaked industry memo set from a public relations campaign called the &#8220;Information Council for the Environment&#8221; (ICE) supposedly containing the &#8220;reposition global warming&#8221; strategy goal, which targeted &#8220;older, less-educated males&#8221; and &#8220;younger, lower-income women.&#8221;<\/p>\n<p>Speculation on who was connected to the ICE campaign varies.<\/p>\n<ul>\n<li>Exxon, according to Al Gore<\/li>\n<li>a nebulous unnamed &#8220;<em>group of utility and coal companies<\/em>&#8221; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/03\/THio-pg-34.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">according to Ross Gelbspan<\/a><\/li>\n<li>politicians, as <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/politicians-reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">one journalist reported<\/a><\/li>\n<li>nebulous unnamed oil companies, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/oil-industry-reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">according one blogger<\/a><\/li>\n<li>the Western Fuels Association, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Monbiot-WFA-reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">according to UK <em>Guardian<\/em> journalist George Monbiot<\/a><\/li>\n<li>and the National Coal Association, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2013\/06\/ErintheB-360.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">according to Al Gore<\/a>.<\/li>\n<\/ul>\n<p>Wait. What?<\/p>\n<p>That&#8217;s only the tip of the proverbial iceberg. If the situation surrounding those leaked memos was ironclad, you wouldn&#8217;t find problems with&#8230;<\/p>\n<ul>\n<li>whether that strategy\/targeting memo subset was actually used <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/10\/Arnold-corroborates.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">or not<\/a><\/li>\n<li>where copies of them were archived <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/10\/AMS-Archivist.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">or not<\/a><\/li>\n<li>whether Dr Singer was a participant in the ICE campaign operating under those memo guidelines <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/02\/THiOpg34Pback.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">or not<\/a><\/li>\n<li>whether Ross Gelbspan was <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2013\/06\/AnIncT-263.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the discoverer<\/a> of them <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2014\/02\/NY-Times-Sierra-Club-1024x743.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">or not<\/a><\/li>\n<li>whether ICE memo &#8216;discoverer&#8217; Ross Gelbspan was a Pulitzer winner <a href=\"http:\/\/www.pulitzer.org\/search\/Gelbspan\" target=\"_blank\" rel=\"noopener noreferrer\">or not<\/a><\/li>\n<\/ul>\n<p>I could go on for pages and pages. But then, that&#8217;s what the entire focus of this GelbspanFiles blog is all about, many have <a href=\"http:\/\/gelbspanfiles.com\/?tag=s-fred-singer\" target=\"_blank\" rel=\"noopener noreferrer\">references to Dr Singer<\/a>.<\/p>\n<p>So why do these court cases bring up Dr Singer&#8217;s name at all? I suggest that, arguably in the eyes of Al Gore, he is &#8220;<a href=\"https:\/\/pbs.twimg.com\/media\/DQ9YNttVAAAOrFT.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the most dangerous man on the planet<\/a>.&#8221; Consider Dr Singer&#8217;s account of slander efforts against him in <a href=\"https:\/\/www.americanthinker.com\/articles\/2006\/06\/gores_grave_new_world.html\" target=\"_blank\" rel=\"noopener noreferrer\">the situation involving Al Gore&#8217;s mentor professor<\/a> recanting his position about the certainty of man-caused global warming \u2026. and how that effort <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/01\/Singer-Hoover-setttlement.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">failed<\/a>. Consider the failure situation in which Al Gore was admonished on public TV <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/01\/Nightline-94.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">by ABC News&#8217; Ted Koppel<\/a> regarding efforts to portray Dr Singer as a &#8216;paid industry shill.&#8217; Consider the potential failure facing Naomi Oreskes&#8217; claims about a 100% scientific consensus on man-caused global warming, if <a href=\"https:\/\/www.youtube.com\/watch?v=15iPIG3YJbo&amp;t=322\" target=\"_blank\" rel=\"noopener noreferrer\">her &#8216;attackers&#8217;<\/a> &#8211; namely <a href=\"https:\/\/www.youtube.com\/watch?v=15iPIG3YJbo&amp;t=430\" target=\"_blank\" rel=\"noopener noreferrer\">Dr Singer<\/a> &#8211; was able to debunk her claim. Consider how such a failure would reflect on Al Gore, whose 2006 movie led up <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/05\/Gore-Oreskes-928-0.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">to that climax revelation<\/a>.<\/p>\n<p>What&#8217;s your course of action to save your global warming agenda, particularly if you can&#8217;t dispute refute science-based \/ statistic analysis-based material from one of your fiercest critics and his associates? You create a movie where you <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/06\/AnIncT-Reposit-Doubt.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">compare the opposition to tobacco industry shills<\/a> &#8211; sorry, <a href=\"https:\/\/www.youtube.com\/watch?v=RkuPPNolAx0&amp;t=72\" target=\"_blank\" rel=\"noopener noreferrer\">movies, plural<\/a> &#8211; and you brainstorm lawsuit action which <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/03\/Oreskes-WFA-tobacc.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">compares the opposition to the tobacco industry<\/a>. Dropping <a href=\"https:\/\/www.youtube.com\/watch?v=hd4Udhnha2A&amp;t=3203\" target=\"_blank\" rel=\"noopener noreferrer\">giant hints<\/a> about that in front of Attorneys General along the way.<\/p>\n<p>Enviro-activists believe they are headed toward the light at the end of the tunnel on the man-caused global warming issue with this growing collection of lawsuits against fossil fuel companies. But in putting all their eggs in the one basket of &#8216;crooked skeptics,&#8217; this looks to me more like the locomotive light of an oncoming libel\/slander retaliatory legal action train which could destroy the whole issue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>That&#8217;s one of the pair of global warming lawsuits I covered in my October 6, 2017 &#8220;People of the State of California v.
