{"id":12431,"date":"2023-03-31T10:53:57","date_gmt":"2023-03-31T17:53:57","guid":{"rendered":"http:\/\/gelbspanfiles.com\/?p=12431"},"modified":"2025-06-06T16:15:39","modified_gmt":"2025-06-06T23:15:39","slug":"climate-homicide-prosecuting-big-oil-for-climate-deaths-a-k-a-we-still-only-have-worthless-evidence-and-suspect-sources-backing-this","status":"publish","type":"post","link":"http:\/\/gelbspanfiles.com\/?p=12431","title":{"rendered":"&#8220;Climate Homicide: Prosecuting Big Oil For Climate Deaths&#8221; (a.k.a. &#8220;we still only have <i>worthless evidence and suspect sources<\/i> backing this.&#8221;)"},"content":{"rendered":"<p>The breaking <a href=\"https:\/\/www.google.com\/search?q=%22Climate+Homicide%22&amp;tbs=cdr%3A1%2Ccd_min%3A3%2F20%2F2023%2Ccd_max%3A3%2F31%2F2023&amp;tbm=\" target=\"_blank\" rel=\"noopener\">&#8216;political climate news&#8217; last week<\/a> concerned the Harvard Environmental Law Review&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-DRAFT.jpg\" target=\"_blank\" rel=\"noopener\"><em>draft version<\/em><\/a> of <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Climate-Homicide.pdf\" target=\"_blank\" rel=\"noopener\">a scholarly paper<\/a> (not due to be actually published <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-2024.jpg\" target=\"_blank\" rel=\"noopener\"><strong>until 2024<\/strong><\/a>) posing the idea that oil companies could be criminally charged with committing &#8216;climate homicide resulting from deceiving the public about the harm of burning fossil fuels.&#8217; Particularly ludicrous to me was the statement in one of those news reports by one of the paper&#8217;s authors concerning <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/EENews-Clima-Homicide%E2%84%A2.jpg\" target=\"_blank\" rel=\"noopener\">the pitch of this idea to plaintiffs<\/a>:<\/p>\n<blockquote><p>We have some indication they\u2019re at least listening and curious,\u201d said David Arkush, director of Public Citizen\u2019s climate program and a fellow at the Roosevelt Institute. \u201cTo someone who knows the criminal law, there\u2019s a moment of &#8216;What!?&#8217; and then, &#8216;<strong>It&#8217;s OK.<\/strong> <span style=\"color: #ff0000;\">It&#8217;s not crazy<\/span>.&#8217;<\/p><\/blockquote>\n<p>Not only is this notion crazy, it would be an act of political suicide.<!--more--><\/p>\n<p>Because they&#8217;d have to justify such a drastic action with verifiable facts.<\/p>\n<p>Let me explain why \u2014 whenever I see some prominent accuser hurl the &#8220;<em>Big Oil disinformation <\/em>\/<em> crooked skeptic scientists<\/em>&#8221; accusation, I do key word \/ name searches within the accusation to see if the &#8216;usual suspects&#8217; pop up. In this paper, they did, and the more I look at it, the more it resembles the assembly of material seen within nearly all of the current ExxonKnew-style lawsuits which seem to follow a preformatted template, citing supposedly damaging &#8216;evidence&#8217; from dubious sources. Rather than bolster the overall case that &#8216;Big Oil &amp; Coal&#8217; conspired in disinformation campaigns to deceive the public about the certainty of catastrophic global warming, this paper is just another log thrown into the fire of an apparent conspiracy promulgated by a core clique of enviro-activists to deceive the public into believing the industry ran disinformation campaigns.<\/p>\n<p>If there&#8217;s anyone begging to be prosecuted, or at least minimally held accountable for epic-level defamation of skeptic climate scientists, it&#8217;s that core clique of enviro-activists. Part of an investigation should concern why people such as the two authors of this paper are literally unable to come up with any &#8216;evidence&#8217; outside of what the public has already seen from those enviro-activists after two+ decades of this worn-out &#8216;industry disinformation campaigns&#8217; accusation.<\/p>\n<p>At some future time, I should create a new post for my <a href=\"http:\/\/gelbspanfiles.com\/?cat=125\" target=\"_blank\" rel=\"noopener\">&#8220;Background&#8221; series<\/a> with a key word \/ name search checklist of what to look for in these kinds of prominent accusations. Today, the bulletpoint list below will have to do, with the blog post links for the first two items and tag category links for the people listed where they are significantly featured in the posts within each category. I do have more. Plenty more. Like I say <a href=\"https:\/\/www.linkedin.com\/in\/russell-cook-769287a4\/\" target=\"_blank\" rel=\"noopener\">at my LinkedIn account page<\/a>, though, &#8220;<em>If you&#8217;re associated with one of the defendant law firms in the two dozen+ &#8220;Exxon Knew&#8221;-style global warming lawsuits, or are a congressional staffer, or are a traditional, objective, unbiased news reporter, you&#8217;re in the right place<\/em>.&#8221;<\/p>\n<p style=\"padding-left: 40px;\">\u2022 Key words: &#8220;reposition global warming as theory&#8221; \u2014 out of the rejected <a href=\"http:\/\/gelbspanfiles.com\/?p=7477\" target=\"_blank\" rel=\"noopener\">worthless memo set<\/a> proposed to the Western Fuels Association&#8217;s &#8220;Information Council for the Environment&#8221; public relations campaign in 1991. This literally the &#8216;most viable-sounding&#8217; bit of evidence in enviro-activists&#8217; accusation arsenal.<br \/>\n\u2022 1998 American Petroleum Institute (API) \u201cVictory will be achieved when average citizens understand uncertainties in climate science\u201d memos. This <a href=\"http:\/\/gelbspanfiles.com\/?p=8211\" target=\"_blank\" rel=\"noopener\">worthless<\/a>, never-implemented set, surrounded by problematic narratives about <a href=\"http:\/\/gelbspanfiles.com\/?cat=165\" target=\"_blank\" rel=\"noopener\">its origins and who favored it before they didn&#8217;t<\/a>, is literally the second-best bit of evidence in enviro-activists&#8217; accusation arsenal.<br \/>\n\u2022 Key names: Ross Gelbspan, who&#8217;s second career is built on the &#8220;reposition global warming&#8221; memos as the result of <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/03\/THio-pg-34.jpg\" target=\"_blank\" rel=\"noopener\">his 1997 &#8220;The Heat is On&#8221; book<\/a>.<br \/>\n\u2022 Kert Davies, whose career is built on both memo sets, currently heads the Climate Investigations Center <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/05\/Davies-CIC-ClimFiles-announce-Knight-funded.jpg\" target=\"_blank\" rel=\"noopener\">with its climatefiles.com platform<\/a>. My <a href=\"http:\/\/gelbspanfiles.com\/?tag=kert-davies\" target=\"_blank\" rel=\"noopener\">tag category of him<\/a> is many pages long.<br \/>\n\u2022 Naomi Oreskes, who&#8217;s second career is built on the &#8220;reposition global warming&#8221; memos she initially detailed in <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/07\/OreskesPPT-08.jpg\" target=\"_blank\" rel=\"noopener\">her 2007-&#8217;08 PowerPoint presentation<\/a>. Three tag categories, one for <a href=\"http:\/\/gelbspanfiles.com\/?cat=157\" target=\"_blank\" rel=\"noopener\">her faulty narratives<\/a>, another for <a href=\"http:\/\/gelbspanfiles.com\/?cat=156\" target=\"_blank\" rel=\"noopener\">her inconsistent &#8216;discovery odyssey tales&#8217;<\/a> and a third <a href=\"http:\/\/gelbspanfiles.com\/?tag=naomi-oreskes\" target=\"_blank\" rel=\"noopener\">&#8216;other significant appearances&#8217; one<\/a>.<br \/>\n\u2022 <a href=\"http:\/\/gelbspanfiles.com\/?tag=geoffrey-supran\" target=\"_blank\" rel=\"noopener\">Geoffrey Supran<\/a>, a subordinate of Oreskes. \u2022 <a href=\"http:\/\/gelbspanfiles.com\/?tag=ben-franta\" target=\"_blank\" rel=\"noopener\">Ben Franta <\/a>\u2022 <a href=\"http:\/\/gelbspanfiles.com\/?tag=chris-mooney\" target=\"_blank\" rel=\"noopener\">Chris Mooney <\/a>\u2022 <a href=\"http:\/\/gelbspanfiles.com\/?tag=amy-westervelt\" target=\"_blank\" rel=\"noopener\">Amy Westervelt<\/a>\u00a0\u2022 <a href=\"http:\/\/gelbspanfiles.com\/?tag=Carroll-Muffett\" target=\"_blank\" rel=\"noopener\">Carroll Muffett<\/a><\/p>\n<p>Now, in regard to this &#8220;Climate Homicide&#8221; paper, in an E&amp;E News interview about it, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Arkush-no-factual-barriers.jpg\" target=\"_blank\" rel=\"noopener\">one of the paper&#8217;s authors said<\/a>,<\/p>\n<blockquote><p>We concluded there aren\u2019t really any legal or factual barriers to prosecution.<\/p><\/blockquote>\n<p>Despite the paper&#8217;s declarations that the collective fossil fuel industry was fully aware in the 1960s \/&#8217;70s of &#8220;climate change&#8221; &#8211; to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-warming.jpg\" target=\"_blank\" rel=\"noopener\"><strong>a warmer climate<\/strong><\/a>, not a cooler one, the industry could not have known with any certainty that the burning of their products caused the warming in the face of all the then-current concern about <a href=\"https:\/\/www.newspapers.com\/image\/608382552\/?clipping_id=94451013\" target=\"_blank\" rel=\"noopener\">impending global cooling<\/a> &#8211; <a href=\"https:\/\/www.newspapers.com\/image\/520743412\/?clipping_id=116184396\" target=\"_blank\" rel=\"noopener\"><em>cooling!<\/em><\/a><\/p>\n<p>Then there&#8217;s the fact that PhD-level climatologists \/ atmospheric physicists, and experts in statistical data gathering and analysis can provide uncounted hours of science-based evidence that, despite the paper&#8217;s conclusion about &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-consensus.jpg\" target=\"_blank\" rel=\"noopener\"><em>the extent of scientific consensus about the role of fossil fuels in altering the climate<\/em><\/a>,&#8221; the &#8220;show of hands&#8221; opinion on catastrophic man-caused global warming is a completely untenable assertion.<\/p>\n<p>But let&#8217;s set that aside and examine the facts of the paper&#8217;s political accusations:<\/p>\n<p>Despite referring to disinformation campaigns <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-disinfo-campaigns.jpg\" target=\"_blank\" rel=\"noopener\">eight times<\/a>, the paper never mentions the far more viable-sounding &#8220;reposition global warming&#8221; memos as evidence \u2026 but an illustrative situation about those memos arises from the authors <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-thx-Gerrard.jpg\" target=\"_blank\" rel=\"noopener\">thanking Michael B. Gerrard<\/a> on page 1. In a 2007 book Gerrard edited, he missed how one of the chapter contributing authors attributed the &#8220;reposition global warming&#8221; memos <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Gerrard-API-reposit2-1024x622.jpg\" target=\"_blank\" rel=\"noopener\">to <strong>the American Petroleum Institute<\/strong><\/a> &#8211; an error the chapter author and Gerrard didn&#8217;t fact-check which came out of the subsequently dismissed <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/02\/ComerVMurph-reposit.jpg\" target=\"_blank\" rel=\"noopener\"><em>Comer v Murphy Oil<\/em> lawsuit<\/a> \u2014 an error that traces back to a <em>Seattle Times<\/em> reporter who <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/02\/SeattleT-Gelb-reposit.jpg\" target=\"_blank\" rel=\"noopener\">incorrectly said<\/a> Ross Gelbspan was the first to uncover the memos. &#8216;Oil interests&#8217; and the &#8220;<em>reposition global warming<\/em>&#8221; phrase is as close as the article ever gets to what is said in the <em>Comer v. Murphy<\/em> lawsuit filing, the article never directly mentions the API.<\/p>\n<p>Facts matter. When folks like authors and editors and reporters don&#8217;t do their due diligence about authoritative assertions, this can only go rapidly downhill from there.<\/p>\n<p>It sure does in this &#8220;Climate Homicide&#8221; paper. The one-and-only example the paper&#8217;s authors offer of disinformation campaign efforts is <strong>the American Petroleum Institute<\/strong> &#8220;victory&#8221; memos.<\/p>\n<p>But without even referencing its most infamous phrase.<\/p>\n<p><img loading=\"lazy\" class=\"alignleft\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-near-victory.jpg\" width=\"316\" height=\"231\" \/><\/p>\n<blockquote><p>\u2026 in 1998, API drafted a communications plan, with the principal goal of &#8220;<span style=\"color: #ff0000;\">defeat<\/span>[ing]&#8221; the Kyoto Protocol, emphasizing that victory could not be declared by FFCs until victory could not be declared by FFCs until &#8220;<span style=\"color: #ff0000;\">no further efforts to thwart the threat of climate change<\/span>&#8221; exist \u2026<\/p><\/blockquote>\n<p>Have no fear, the most infamous phrase is right above that &#8220;thwart the threat&#8221; bit.<\/p>\n<p><img loading=\"lazy\" class=\"aligncenter\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Victory-will-thwart.jpg\" width=\"299\" height=\"280\" \/><\/p>\n<p style=\"padding-left: 40px;\">\u00a0(the Greenpeace Investigations website with these scans went offline <a href=\"http:\/\/gelbspanfiles.com\/?p=14012\" target=\"_blank\" rel=\"noopener\">in late spring 2022<\/a>, but you can still <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/GP-archive-Victory-scans.jpg\" target=\"_blank\" rel=\"noopener\">download your own copy<\/a> of their horribly degraded photocopy scans from the Internet Archive version <a href=\"https:\/\/web.archive.org\/web\/20190816033833\/https:\/\/research.greenpeaceusa.org\/?a=view&amp;d=4383\" target=\"_blank\" rel=\"noopener\">here<\/a> or look at <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Global-Climate-Science-Communications-Plan.pdf\" target=\"_blank\" rel=\"noopener\">my copy online<\/a>. Need a word-searchable version? It&#8217;s <a href=\"https:\/\/web.archive.org\/web\/19990223192759\/http:\/\/www.envirotrust.com:80\/rel98apr27.html\" target=\"_blank\" rel=\"noopener\">here<\/a>, after the &#8220;Memo Follows&#8221; headline.)<\/p>\n<p>Interesting, isn&#8217;t it, that this paper&#8217;s footnote citation for their &#8220;thwart the threat&#8221; bit only goes to a reference to &#8220;<em>Memorandum from Joe Walker<\/em>&#8221; without providing either Kert Davies&#8217; page link for his <a href=\"https:\/\/www.climatefiles.com\/exxonmobil\/1998-global-climate-science-communications-team-action-plan\/\" target=\"_blank\" rel=\"noopener\">new<\/a> or <a href=\"https:\/\/www.documentcloud.org\/documents\/784572-api-global-climate-science-communications-plan.html\" target=\"_blank\" rel=\"noopener\"><em>old<\/em> scans copy<\/a>, or to <a href=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2015\/12\/Global-Climate-Science-Communications-Plan-1998.pdf\" target=\"_blank\" rel=\"noopener\">Inside Climate News&#8217; copy<\/a>? Interesting, isn&#8217;t it, that when viewed in its full context that the above red-highlighted direct-quote words end up being much more of a simple truism?<\/p>\n<blockquote><p>Unless &#8220;climate change&#8221; becomes a non-issue, <strong>meaning that the Kyoto proposal is <span style=\"color: #ff0000;\">defeat<\/span>ed and there are <span style=\"color: #ff0000;\">no further <\/span><\/strong>initiatives<span style=\"color: #ff0000;\"><strong> to thwart the threat of climate change<\/strong><\/span>, there may be no moment when we can declare victory for our efforts. It will be necessary to establish measurements for the science effort to track progress toward achieving the goal and strategic success.<\/p><\/blockquote>\n<p>The authors of this paper dig their hole here one huge increment deeper when they follow their out-of-context truncated quote with <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-ced-the-science.jpg\" target=\"_blank\" rel=\"noopener\">a claim that<\/a>,<\/p>\n<blockquote><p>Rather than &#8220;<span style=\"color: #ff0000;\">ced<\/span>[ing] <span style=\"color: #ff0000;\">the science<\/span>,&#8221; and fighting climate regulation with economic arguments, the plan argued that it would be more effective to sow doubt over whether climate change was happening at all \u2026<\/p><\/blockquote>\n<p>Uh, no, the full context paragraph <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Victory-industry-ceded.jpg\" target=\"_blank\" rel=\"noopener\"><strong><em>does not say that at all.<\/em><\/strong><\/a><\/p>\n<blockquote><p>The advocates of global warming have been successful on the basis of skillfully <strong>misrepresenting the science and the extent of agreement on the science<\/strong>, while industry and its partners <span style=\"color: #ff0000;\">ceded the science<\/span> and fought on the economic issues. Yet <strong>if we can show that science does not support the Kyoto treaty &#8211; which most true climate scientists believe to be the case<\/strong> &#8211; this puts the United States in a stronger moral position and frees its negotiators from the need to make concessions as a defense against perceived selfish economic concerns.<\/p><\/blockquote>\n<p>They dig their problem even deeper in the continuation of their bit above with <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-mo-out-of-context.jpg\" target=\"_blank\" rel=\"noopener\">another six utterly out-of-context quoted words<\/a>:<\/p>\n<blockquote><p>\u2026it would be more effective to sow doubt over whether climate change was happening at all, and, if so, &#8220;whether humans &#8220;<span style=\"color: #ff0000;\">really have any influence on it<\/span>, \u2026<\/p><\/blockquote>\n<p><a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Victory-humans-any-infl.jpg\" target=\"_blank\" rel=\"noopener\">Uh, no<\/a> &#8230;<\/p>\n<blockquote><p>The climate change theory being advanced by the treaty supporters is <strong>based primarily on forecasting models with a very high degree of uncertainty.<\/strong> In fact, its not known for sure whether (a) climate change actually is occurring, or (b) if it is, whether humans <span style=\"color: #ff0000;\">really have any influence on it<\/span>.<\/p><\/blockquote>\n<p>The entire 9 page collection of lousy scans does not actually contain anything remotely similar to a directive, suggestion, or subtle hint that anybody needs to &#8220;sow doubt&#8221;, &#8220;manufacture doubt,&#8221; &#8220;prompt doubt.&#8221; The simple fact is that the only time the word &#8220;doubt&#8221; occurs is in reference how many people <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Victory-doubts.jpg\" target=\"_blank\" rel=\"noopener\">responded to a particular survey<\/a>.<\/p>\n<p>Making this worse, the paper&#8217;s authors pile on by saying that in regard to the &#8220;victory&#8221; memos&#8217;s two truncated bits of sentence they quote,<\/p>\n<blockquote><p>\u2026 both of which quickly become major elements of the FFCs&#8217; playbook of doubt and denial.<\/p><\/blockquote>\n<p>And <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-cites-Mooney.jpg\" target=\"_blank\" rel=\"noopener\">their citation source to back this up<\/a> is Chris Mooney&#8217;s 2005 &#8220;Some Like it Hot&#8221; 2005 <em>Mother Jones<\/em> article. He only used the word &#8220;doubt&#8221; twice, first to mention the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/MJ-Mooney-Hot-reasonable-doubt.jpg\" target=\"_blank\" rel=\"noopener\">&#8220;reasonable science doubt of 1990<\/a>, and then again right after he clearly compares the &#8220;victory&#8221; memo to a tobacco industry memo, and then adds that there was no evidence the &#8220;victory&#8221; memo was ever implemented in any form.<\/p>\n<p><img loading=\"lazy\" class=\"aligncenter\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/MJones-victory-doubt-never-impl.jpg\" width=\"417\" height=\"301\" \/><\/p>\n<p>API Executive VP \/ COO William O\u2019Keefe <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/04\/Newsweek-OKeefe-API-never-impl.jpg\" target=\"_blank\" rel=\"noopener\">told <em>Newsweek<\/em> magazine directly<\/a> that the &#8220;victory&#8221; memos&#8217; plan was <strong>never implemented.<\/strong> I have that on firsthand corroboration from him <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/GF-OKeefe-says-never-impl.jpg\" target=\"_blank\" rel=\"noopener\">that the plan was <strong>never implemented<\/strong><\/a><strong>.<\/strong> Truth is, the Kyoto Treaty which the API plan was musing about defeating was actually already dead on arrival in the United States, even prominent enviro-activists <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/04\/Passacantando-describes-Byrd-Hagel.jpg\" target=\"_blank\" rel=\"noopener\">knew the U.S. Senate would never ratify it<\/a>.<\/p>\n<p>Who else compared a never-implemented fossil fuel industry memo to a tobacco industry memo? Oh, right. Al Gore.<\/p>\n<p><img loading=\"lazy\" class=\"aligncenter\" src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/07\/AnIncTr-Reposti-Doubt2.jpg\" width=\"426\" height=\"471\" \/><\/p>\n<p>Any given <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/Arnold-corroborates3.jpg\" target=\"_blank\" rel=\"noopener\">rejected<\/a>, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/11\/NYT-advice-unsold.jpg\" target=\"_blank\" rel=\"noopener\">unsolicited<\/a> or never implemented proposal or plan, by default, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/GF-Fox-sez-BBC-disinforms-Reposit-Victory.jpg\" target=\"_blank\" rel=\"noopener\">cannot serve as evidence that particular actions took place<\/a>.<\/p>\n<p>But I digress there. Except not quite. Remember the list of bulletpoint names above? Dig into the links I have for them and you soon see every one of them is separated by three degrees or less from Ross Gelbspan&#8217;s beloved &#8220;reposition global warming&#8221; memos accusation, where all would likely not hesitate in the least to call those memos &#8220;smoking gun&#8221; evidence of industry-led disinformation campaigns.<\/p>\n<p>Who&#8217;re the sources of &#8216;damaging material&#8217; cited in this &#8220;Climate Homicide&#8221; paper? Kert Davies&#8217; climatefiles <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-climatefiles-5.jpg\" target=\"_blank\" rel=\"noopener\">5 times<\/a>; Naomi Oreskes <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Oreskes-6.jpg\" target=\"_blank\" rel=\"noopener\">6 times<\/a>; Geoffrey Supran <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Supran-4.jpg\" target=\"_blank\" rel=\"noopener\">4 times<\/a>; Ben Franta <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Franta-4.jpg\" target=\"_blank\" rel=\"noopener\">4 times<\/a>; Chris Mooney <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Mooney-2.jpg\" target=\"_blank\" rel=\"noopener\">twice<\/a>; Amy Westervelt <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Westervelt-2.jpg\" target=\"_blank\" rel=\"noopener\">twice<\/a>; Carroll Muffett <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Muffett-1.jpg\" target=\"_blank\" rel=\"noopener\">once<\/a>. There are other name problems, but I&#8217;ll stop here.<\/p>\n<p>But there&#8217;s <strong><em>always more<\/em><\/strong>. Regarding that last name, Muffett, notice right below his citation is the next footnote about the &#8220;James Black Report.&#8221; This paper cites Kert Davies&#8217; Climate Files site for several different industry documents, but regarding the &#8220;James Black Presentation to Exxon,&#8221; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-Black-report-ICN.jpg\" target=\"_blank\" rel=\"noopener\">they cite Inside Climate News<\/a>. Who else did that same thing \u2026. for <strong><em>the identical James Black documents?<\/em><\/strong> <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/04\/Charleston-ICN-Davies.jpg\" target=\"_blank\" rel=\"noopener\">The Sher Edling law firm<\/a>, as I noted <a href=\"http:\/\/gelbspanfiles.com\/?p=10822\" target=\"_blank\" rel=\"noopener\">in my dissection<\/a> of their <em>Charleston v Brabham Oil <\/em>filing. Naomi Oreskes <a href=\"http:\/\/gelbspanfiles.com\/?p=12023\" target=\"_blank\" rel=\"noopener\">is on retainer with Sher Edling<\/a>.<\/p>\n<p>That&#8217;s what I meant by the &#8220;assembly of material within ExxonKnew-style lawsuits seemingly following a preformatted template citing highly dubious sources.&#8221; This appearance is not helped in the least by the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/04\/Davies-Banerjee.jpg\" target=\"_blank\" rel=\"noopener\">back-to-back appearances of Inside Climate News and Kert Davies<\/a> in last April&#8217;s PBS Frontline report about &#8216;Big Oil running disinformation campaigns.&#8217;<\/p>\n<p>Think the problems end there for the paper&#8217;s authors? Think again.<\/p>\n<p>No later than <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Clima-Homicide%E2%84%A2-protect-profits.jpg\" target=\"_blank\" rel=\"noopener\">the 5th sentence on page 1<\/a>, the authors essentially say the fossil fuel companies poured money into efforts intended to &#8211; bottom line &#8211; protect their vast income.<\/p>\n<p>Flip the idea 180\u00b0. Whose income stands to disappear if the idea of man-caused catastrophic global warming is proven to be entirely overblown.<\/p>\n<p>The hint is seen in the label for one of the paper&#8217;s authors, David Arkush, footnote #1 on that first page: &#8220;<a href=\"https:\/\/www.citizen.org\/about\/person\/david-arkush\/\" target=\"_blank\" rel=\"noopener\"><em>Director, Public Citizen\u2019s Climate Program<\/em><\/a>.&#8221;<\/p>\n<p>Who&#8217;s one of the funders of Public Citizen? The <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/PublicCitizen-RFF-funding.jpg\" target=\"_blank\" rel=\"noopener\">Rockefeller Family Fund<\/a>. Who&#8217;s the Director of the Rockefeller Family Fund? <a href=\"https:\/\/rffund.org\/about\/staff\" target=\"_blank\" rel=\"noopener\">Lee Wasserman<\/a>. Who&#8217;s name was seen at the top of a 2016 leaked email that detailed a plan to portray Exxon as corrupt in the eyes of the public? <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/03\/Usual-suspects-Wasserman-Passac-Davies-Muffett.jpg\" target=\"_blank\" rel=\"noopener\">Wasserman<\/a>, along with Kert Davies, Carroll Muffett, and Davies&#8217; boss John Passacantando at both Greenpeace <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/08\/OA-staff-Passac-Davies2.jpg\" target=\"_blank\" rel=\"noopener\">and the old forgotten<\/a> Ozone Action environmental group. Ozone Action being the group which was the first to prompt lasting, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/OA-reposit-Passac-Mar-May-96-1024x771.jpg\" target=\"_blank\" rel=\"noopener\">ongoing media traction<\/a> for the &#8220;reposition global warming&#8221; memos, worthless as they were even when <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/IndyNews.jpg\" target=\"_blank\" rel=\"noopener\">mentioned in generic form<\/a>. Who is Passacantando <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/12\/Wake-Forest-Passac-Guide.jpg\" target=\"_blank\" rel=\"noopener\">married to<\/a>? Rockefeller Family Fund <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/01\/RFF-Guide2-1024x678.jpg\" target=\"_blank\" rel=\"noopener\">Assistant Director Lisa Guide<\/a>. Who, after leaving Greenpeace and starting up a mystery LLC business has earned nearly $16 million in dark money? <a href=\"http:\/\/gelbspanfiles.com\/?p=12705\" target=\"_blank\" rel=\"noopener\">John Passacantando<\/a>,\u00a0 where portions of that money is reported to be funneled to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/07\/Freebeacon-Passac-Davies-dark--1024x828.jpg\" target=\"_blank\" rel=\"noopener\">Kert Davies&#8217; efforts<\/a> to push the idea that the fossil fuel industry ran disinformation campaigns. Who provided funding to Geoffrey Supran and Naomi Oreskes&#8217; paper castigating Exxon for running disinformation campaigns?
