Sunoco LP, et al.<\/i>"},"content":{"rendered":"<p>Just three weeks ago, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/ICN-Maui.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">enviro-activists applauded<\/a> the October 12, 2020 filing of <a href=\"https:\/\/web.archive.org\/web\/20201024222532\/https:\/\/www.mauicounty.gov\/DocumentCenter\/View\/124390\/Maui-County-Climate-Change-Litigation-Complaint\" target=\"_blank\" rel=\"noopener\">the <em>Maui v. Sunoco<\/em> lawsuit<\/a>. No doubt the residents there would see the logic of sharing pretty much all of the lawsuit details with the neighboring <a href=\"https:\/\/www.honolulu.gov\/rep\/site\/ccsr\/City_and_County_of_Honolulu_vs._Sunoco_LP_et_al.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Honolulu v. Sunoco<\/em><\/a> one \u2014 same <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Honolulu-Maui-Table-of-C-1024x585.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Table of Contents format<\/a>, same <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Honolulu-Maui-Intro-copy-1024x329.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Introduction wording<\/a>, same <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Honolulu-Maui-campaign-1024x381.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">accusatory section<\/a>, etc. Makes sense, Maui and Honolulu are neighbors supposedly suffering the same catastrophic man-caused global warming harm. But wouldn&#8217;t the residents of Maui be a little disappointed to find out their lawsuit appears to be little more than a pure hand-me-down copy of <a href=\"https:\/\/attorneygeneral.delaware.gov\/wp-content\/uploads\/sites\/50\/2020\/09\/2020-09-09-Final-Complaint.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Delaware v. BP<\/em><\/a> which is also handled by the same law firm handling their case? After all, <em>Delaware<\/em> has nearly the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Delaware-campaign.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">same accusatory section<\/a>, nearly the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Delaware-Intro.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">same Introduction wording<\/a>, and nearly the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Delaware-Table-of-C.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">same Table of Contents<\/a>.<!--more--><\/p>\n<p>Despite not yet appearing on the Sher Edling law firm&#8217;s page for their <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/11-4-20-SherEdling-12boiler1Assist.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">collection of lawsuit filings<\/a> as of this publication date, they are clearly <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/10\/Sher-Edling-official-Maui-filing.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the law firm for the plaintiffs<\/a>. What other ingredients are needed to make this <em>Maui<\/em> filing into a Sher Edling law firm boilerplate copy?<\/p>\n<ul>\n<li>Reliance on the <a href=\"http:\/\/gelbspanfiles.com\/?p=7477\" target=\"_blank\" rel=\"noopener noreferrer\">worthless<\/a> &#8220;reposition global warming&#8221; memo set for the accusation that industry-orchestrated disinformation campaigns exist <strong>\u2014<\/strong><strong>check<\/strong>. Like I said in <a href=\"http:\/\/gelbspanfiles.com\/?p=10896\" target=\"_blank\" rel=\"noopener noreferrer\">my dissection of the <em>Delaware<\/em> filing<\/a>, it&#8217;s <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Sher-Edling-reposit-repetition.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">getting really repetitive<\/a> to point that fault out. The new tiny wrinkle in the conga line repetition here is the new addition of brackets around the word &#8220;reposition,&#8221; along with the strangely redundant additional citation of the Union of Concerned Scientists&#8217; Dossier, as though this was an attempt to &#8216;pad&#8217; the number of sources for these worthless memos. I detailed <em>that<\/em> <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/11\/UCS-cites-GP-OA.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">UCS citation cascade problem<\/a> in <a href=\"http:\/\/gelbspanfiles.com\/?p=2891\" target=\"_blank\" rel=\"noopener noreferrer\">my July 9, 2015 blog post<\/a>.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Maui-reposit.jpg\" \/><\/p>\n<ul>\n<li>Reliance on the <a href=\"http:\/\/gelbspanfiles.com\/?p=8211\" target=\"_blank\" rel=\"noopener noreferrer\">worthless<\/a> 1998 API &#8220;victory will be achieved&#8221; memo set for the same accusation <strong>\u2014<\/strong><strong>check<\/strong>. To aid readers in finding my dissections of the myriad faults surrounding reliance on that memo set, including these filings&#8217; suspect citation of a &#8216;mystery&#8217; &#8220;documentcloud&#8217; website link, I&#8217;ve created a new post category, &#8220;<a href=\"http:\/\/gelbspanfiles.com\/?cat=165\" target=\"_blank\" rel=\"noopener noreferrer\">API memo set&#8217;s faults<\/a>,&#8221; now separate from my general &#8220;<a href=\"http:\/\/gelbspanfiles.com\/?cat=146\" target=\"_blank\" rel=\"noopener noreferrer\">American Petroleum Institute<\/a>&#8221; category.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Maui-Victory.jpg\" \/><\/p>\n<ul>\n<li>Reliance on the &#8220;Black Report&#8221; to claim Exxon knew back in 1977-&#8217;78 how the polar regions were going to see huge temperature increases in a few decades <strong>\u2014check<\/strong>. I covered that problem in <a href=\"http:\/\/gelbspanfiles.com\/?p=10822\" target=\"_blank\" rel=\"noopener noreferrer\">my <em>Charleston v Brabham Oil<\/em> dissection<\/a>, including the suspect problem of linking to Kert Davies&#8217; &#8220;Climate Files&#8221; website.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Maui-Black.jpg\" \/><\/p>\n<ul>\n<li>Reliance on a particular narrative about &#8216;Big Oil&#8217; bankrolling skeptic climate scientists who fail to disclose the source of that bankrolling <strong>\u2014check<\/strong>. I covered that wipeout in <a href=\"http:\/\/gelbspanfiles.com\/?p=10896\" target=\"_blank\" rel=\"noopener noreferrer\">my <em>Delaware v. BP<\/em> dissection<\/a>.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/MauiSoon.jpg\" \/><\/p>\n<p>Boilerplate copy, Q.E.D. Well, almost. What does this <em>Maui<\/em> filing <strong><em>not<\/em><\/strong> get to share with its Honolulu neighbor or fellow island state Rhode Island? Reliance on <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/LBJ-speech-3-missing-words.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">critically missing words<\/a> within a speech from President Lyndon Johnson in order to float the unsupportable idea that President Johnson &#8220;knew&#8221; about man-caused global warming in 1965. Compare <em>Rhode Island,<\/em> where I detailed the missing words problem and how it sources to Naomi Oreskes in the second half of <a href=\"http:\/\/gelbspanfiles.com\/?p=7168\" target=\"_blank\" rel=\"noopener noreferrer\">my <em>Rhode Island v. Chevron<\/em> dissection<\/a> \u2026<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2018\/07\/LBJs-3-dots.jpg\" \/><\/p>\n<p>\u2026 to <em>Honolulu<\/em> \u2026<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Honolulu-LBJ-3-dots.jpg\" \/><\/p>\n<p>\u2026 and to <em>Maui<\/em>.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Maui-no-dots.jpg\" \/><\/p>\n<p>What&#8217;s up with that omission, why doesn&#8217;t <em>Maui<\/em> get to have that faulty claim? And how does it work out that Sher Edling&#8217;s <em>Charleston v Brabham Oil<\/em>, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/10\/CharlestonSept9.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">filed on 9\/9\/20<\/a> gets to have that problematic <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Charleston-LBJ-3dots.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Lyndon Johnson 3 dots\/missing words item<\/a> in it, while the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/10\/DelawareSept10.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">next-day-filed<\/a> 9\/10\/20 <em>Delaware v. BP<\/em> <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Delware-no-dots.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">does <strong>not<\/strong><\/a>?<\/p>\n<p>Reporters who don&#8217;t adhere to the basic tenets of journalism want the public to believe there&#8217;s a &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Politico-wave.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">new wave<\/a>&#8221; of these lawsuit filings, or a &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/EE-growing-body-mounting.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">mounting number \/ growing body<\/a>&#8221; of them, or \u2014 only days after the filing of <em>Maui v Sunoco<\/em> \u2014 a &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/wave-swell-AGW-suits.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">coming wave \/ recent swell<\/a>&#8221; of these, each being above reproach with their content.<\/p>\n<p>&#8220;<em>Problems with the assertions in them?&#8221;<\/em>, the reporters exclaim, <em>&#8220;What problems? We don&#8217;t have time to fact-check these things, and besides, the story of organized denial has been well told and documented.<\/em>&#8221; No, it hasn&#8217;t, it&#8217;s where that <a href=\"http:\/\/gelbspanfiles.com\/?p=2907\" target=\"_blank\" rel=\"noopener noreferrer\">citation cascade problem<\/a> rears its ugly head, pointing straight back to basically a single dubious source.<\/p>\n<p>I&#8217;d argue that the latest growing problem is the sheer number of these lawsuit filings that all seem to share a common ingredients list. By <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Current-total-really-7.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">my current count<\/a>, however, an argument could be made that all of the fourteen Sher Edling boilerplate \/ assisted filings could be wadded up into one big single one, while the four Pawa-led ones could be consolidated into a single one as well (where possibly two of those might be transferred into the Sher Edling ball if <a href=\"https:\/\/climatelitigationwatch.org\/wp-content\/uploads\/2018\/12\/SF-CC-2018-11-20-Legal-Services-Agreement-SF-SE-AB-FINAL-EXECUTED.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">their own announcement about two of the Pawa-led California filings<\/a> is an indicator of that action). One plus one plus five &#8216;independently led&#8217; lawsuits equals just seven \u2014 hardly definable as any sort of big wave. And since the <em>D.C. v Exxon<\/em> one that I&#8217;d formerly listed as &#8216;independently led&#8217; was claimed as a Sher Edling one, what assurance do we have that the others that have far too similar of an appearance to Sher Edling&#8217;s filings won&#8217;t get vacuumed up into their giant single wad?<\/p>\n<p>Then there&#8217;s this other problem with reporting about these lawsuit filings, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/Wave-corrobroated.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">nicely illustrated<\/a> by the aforementioned &#8220;coming wave \/ recent swell&#8221; <a href=\"https:\/\/freepressonline.com\/Content\/Home\/Homepage-Rotator\/Article\/A-Coming-Wave-of-Litigation\/78\/720\/70999\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a>:<\/p>\n<blockquote><p>The disinformation campaigns have since been <strong>corroborated by leaked internal memos, including one from the American Petroleum Institute<\/strong>\u2019s Global Climate Science Communications team known as the \u201cvictory memo,\u201d with victory defined as the public coming to \u201cunderstand\u201d the uncertainties of climate science.<\/p><\/blockquote>\n<p>No, they haven&#8217;t. That abject failure is instead what will potentially <strong><em>sink<\/em><\/strong> every one of these lawsuits while also exposing just who it is who put all their faith in the disinformation narrative about &#8216;leaked memos proving skeptic climate scientists colluded with fossil fuel industry execs to deceived the public about the harm of man-caused global warming.&#8217;<\/p>\n<p>Reporters in the mainstream media would know that <a href=\"https:\/\/www.youtube.com\/watch?v=V1EM8s0gxyI&amp;t=11\" target=\"_blank\" rel=\"noopener noreferrer\">Titanic problem<\/a> if only so many of them weren&#8217;t essentially unquestioningly repeating propaganda lines likely fed to them from <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/promulgators.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the very people<\/a> who are trying to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/11\/float-memos-1024x651.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">keep all these lawsuits afloat<\/a>.<\/p>\n<p>Neglected as the global warming issue is among other much bigger controversial news items lately, it&#8217;s still a major indicator of the <strong><em>huge<\/em><\/strong> problem surrounding all of the big controversial news items:\u00a0 mainstream media reporting malfeasance.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Just three weeks ago, enviro-activists applauded the October 12, 2020 filing of the Maui v.
