Brabham Oil Company, et al.<\/i>"},"content":{"rendered":"<p>In just the span of barely the first three weeks of September, four lawsuits suing energy companies for the costs of man-caused global warming were filed, <em>City of Hoboken v. ExxonMobil, et al.<\/em> (9\/2\/20), <em>City of Charleston v Brabham Oil Company, et al.<\/em> (9\/9\/20), <em>Delaware v. BP America Inc, et al.<\/em> (9\/10\/20), and <em>Connecticut v. ExxonMobil Corp.<\/em> (9\/14\/20). These allege the companies knew their products caused harm from global warming while orchestrating disinformation campaigns with &#8216;shill&#8217; experts to deceive the public about the harm. <em>Politico<\/em> summarized these in a <a href=\"https:\/\/politico-energy.simplecast.com\/episodes\/a-new-wave-of-climate-change-lawsuits\" target=\"_blank\" rel=\"noopener noreferrer\">September 16 podcast report<\/a> as part of a &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Politico-wave.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><em>new wave of climate change lawsuits<\/em><\/a>&#8221; against fossil fuel companies &#8220;<em>racking up nationwide<\/em>.&#8221; While no comparison was offered in that report to the way the tobacco industry began to crumble under <a href=\"https:\/\/en.wikipedia.org\/wiki\/Tobacco_Master_Settlement_Agreement\" target=\"_blank\" rel=\"noopener noreferrer\">the weight of lawsuits against it<\/a> in the 1990s, a <a href=\"https:\/\/www.eenews.net\/stories\/1063713839\" target=\"_blank\" rel=\"noopener noreferrer\">same-day report from E&amp;E News<\/a> was <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/EE-growing-body-mounting.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">not the least bit subtle<\/a> about prompting readers to consider how this &#8220;<em>growing body of climate misinformation suits<\/em>&#8221; compares to the tobacco industry&#8217;s situation over its knowledge of the harm of cigarette smoking. No mention was made in either report, of course, regarding dubious claims about the allegedly &#8216;settled science&#8217; of man-caused global warming.<!--more--><\/p>\n<p>It&#8217;s arguably disingenuous for reporters to suggest this is settled science when extensive science-based opposition exists. David Middleton&#8217;s September 14 &#8220;<a href=\"https:\/\/wattsupwiththat.com\/2020\/09\/14\/charleston-sc-junk-climate-lawsuit\/\" target=\"_blank\" rel=\"noopener noreferrer\">Charleston SC Junk Climate Lawsuit<\/a>&#8221; WUWT guest post addressed many of the opposition&#8217;s viewpoints, including some details concerning a <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/cartoonly-absurd.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">&#8216;cartoonly absurd&#8217; graph<\/a> in this <a href=\"https:\/\/www.charleston-sc.gov\/ArchiveCenter\/ViewFile\/Item\/716\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Charleston v Brabham Oil<\/em><\/a> filing. In his remarks about the graph&#8217;s appearance elsewhere, Middleton basically exposed <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/WUWT-Black-graph.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">a sizable problem<\/a> with reporters disingenuously implying there is a &#8216;wave of individual state and city-filed lawsuits&#8217; happening:<\/p>\n<blockquote><p>This cartoon appears on page 62 of this, and <strong>nearly every other<\/strong>, junk climate lawsuit .. <strong>The exact same image, including the caption is in Delaware\u2019s recent junk lawsuit<\/strong>. The graph is from what is known as the &#8220;Black presentation&#8221; and supposedly reveals Exxon\u2019s secret knowledge of climate change \u2026<\/p><\/blockquote>\n<p>It does indeed appear identically <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Delaware-Black-graph.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">on page 77<\/a> in <em>Delaware v. BP<\/em>, and Middleton isn&#8217;t exaggerating about the number of lawsuits referencing that graph and\/or material directly stemming from it. While the graph itself does not appear in the <a href=\"http:\/\/gelbspanfiles.com\/?tag=hagens-berman-pawa\" target=\"_blank\" rel=\"noopener noreferrer\">four Matt Pawa-led lawsuits<\/a>, the Black Report is noted in the text of the lawsuits, <em>King County v. BP<\/em> example <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Pawa-Black.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>, where the source link goes to <a href=\"https:\/\/web.archive.org\/web\/20150921210826\/https:\/\/insideclimatenews.org\/sites\/default\/files\/documents\/James%20Black%201977%20Presentation.pdf\" target=\"_blank\" rel=\"noopener\">Inside Climate News&#8217; (ICN) PDF file<\/a> containing the James Black quote about &#8220;<em>Present thinking holds that man has a time window of five to ten years<\/em>\u2026&#8221; at <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/ICN-Black-quote.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the bottom of its PDF page 3<\/a>, and the graph in its <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/ICN-Black.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">PDF page 26<\/a>.<\/p>\n<p>ICN is the obvious source; many enviro-activists say their &#8220;Exxon Knew&#8221; series of articles (with a <a href=\"https:\/\/twitter.com\/search?q=%23ExxonKnew&amp;f=live\" target=\"_blank\" rel=\"noopener noreferrer\">massively repeated Twitter hashtag<\/a>) is the be-all \/ end-all source for incriminating documents, where their particular <a href=\"https:\/\/insideclimatenews.org\/news\/16092015\/exxon-believed-deep-dive-into-climate-research-would-protect-its-business\" target=\"_blank\" rel=\"noopener noreferrer\">9\/17\/15 article<\/a> was the first with the <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/ICN-PDF-Black-memos.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">direct link<\/a> to their PDF file copy of the Exxon memos which <em>King County<\/em> uses, along with other global warming lawsuits. For example, the supposedly &#8216;<a href=\"http:\/\/gelbspanfiles.com\/?cat=164\" target=\"_blank\" rel=\"noopener noreferrer\">independently led<\/a>\u2019 <em>Hoboken v. ExxonMobil<\/em> lawsuit uses the same &#8220;time window of five to ten years&#8221; quote, but takes a slightly more <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Hoboken-Black-quote.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">circuitous citation path<\/a> about it by linking to an ICN <a href=\"https:\/\/insideclimatenews.org\/documents\/james-black-1977-presentation\" target=\"_blank\" rel=\"noopener noreferrer\">web page link<\/a> which itself then links to ICN&#8217;s PDF file containing the quote and graph. The days-old &#8216;also-supposedly-independently-led&#8217; <em>Connecticut v Exxon<\/em> 9\/14\/20 filing <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Connecticut-Black.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">quotes the same Black Report &#8220;time window&#8221; sentence<\/a>, but skips the trouble of including any sort of citation source altogether. The supposedly independently led <em>D.C. v Exxon<\/em> is also devoid of citation sources, and doesn&#8217;t even bother to assign a name to the Black Report&#8217;s warning about &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/DC-Black-quote2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">double to triple as much warming at the poles<\/a>,&#8221; where their passage about it bears a striking resemblance to <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Hoboken-Black-quote2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">a similar passage in the <em>Hoboken<\/em> filing<\/a> \u2026\u2026. which cites ICN as the source for it.<\/p>\n<p>The similarities don&#8217;t stop there. What other lawsuit looks like that? The &#8216;also-supposedly-independently-led&#8217; <em>Minnesota v American Petroleum Institute, Exxon, et al<\/em>. lawsuit does, but with a twist on the citation source which is <strong><em>not<\/em><\/strong> Inside Climate News:<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Minnesota-Black-quote2.jpg\" \/><\/p>\n<p>Where else is such a similar &#8220;mean temperature \/ poles temperature&#8221; passage found in the <a href=\"http:\/\/gelbspanfiles.com\/?page_id=18\" target=\"_blank\" rel=\"noopener noreferrer\">pile of global warming lawsuits<\/a> accusing &#8216;Big Coal &amp; Oil&#8217; of colluding with skeptic climate scientists in disinformation campaigns?<\/p>\n<p>Remember how WUWT post contributor David Middleton noted the &#8216;cartoonly absurd&#8217; <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Black-graph-mean-polar.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;mean temperature \/ poles temperature&#8221; graph<\/a> is seen in the <em>Charleston<\/em> filing and identically in the <em>Delaware<\/em> filing? Read the text accompanying that graph <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Charleston-Black-textgraph.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">in <em>Charleston<\/em><\/a>, and <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Delaware-Black-textgraph.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">in <em>Delaware<\/em><\/a>, <strong><em>and in<\/em><\/strong> the <em>Honolulu v. Sunoco<\/em> filing, and what do you see?<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Honolulu-Black-textgraph.jpg\" \/><\/p>\n<p>There&#8217;s that text again, identical to what&#8217;s in the sourceless passage in <em>D.C.<\/em> and naturally identical in these three <a href=\"http:\/\/gelbspanfiles.com\/?tag=sher-edling-boilerplate\" target=\"_blank\" rel=\"noopener noreferrer\">Sher Edling boilerplate copy lawsuits<\/a> \u2026. all three of which cite <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/03\/CIC-Davies-ClimFiles.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Kert Davies&#8217; ClimateFiles<\/a> as the source for the text and graph.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Sher-Edlings-CF-Black-source.jpg\" \/><\/p>\n<p>It&#8217;s a potential point of speculation on whether the taxpaying citizens of Delaware and Charleston might be disappointed that they are blessed with what could be described as a used, hand-me-down lawsuit from a city halfway out into the Pacific Ocean. But the citizens of Honolulu might make the same argument about their own lawsuit filing being a hand-me-down through eight prior generations of essentially identical filings dating all the way back to 2017&#8217;s <em>County of San Mateo v. Chevron<\/em>, with its <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/San-Mateo-BlackClimFiles-1024x603.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">variant of the Black Report \/ Kert Davies Climate Files passage<\/a>, and its repeated-in-every-subsequent-filing-elsewhere implication that a leaked memo set with the strategy goal to &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2017\/10\/3-complaints-Reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">reposition global warming<\/a>&#8221; is evidence to prove the existence of fossil fuel industry disinformation campaigns. I&#8217;ve covered the crippling problems with that latter <a href=\"http:\/\/gelbspanfiles.com\/?p=7477\" target=\"_blank\" rel=\"noopener noreferrer\">&#8216;worthless leaked memos&#8217; situation<\/a> and how <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/10\/OA-Gelb-obtained-v2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">they are connected<\/a> to the time when <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/08\/OA-staff-Passac-Davies2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Kert Davies worked at Ozone Action<\/a> in every one of my dissections of these <a href=\"http:\/\/gelbspanfiles.com\/?tag=sher-edling-boilerplate\" target=\"_blank\" rel=\"noopener noreferrer\">Sher Edling lawsuit filings<\/a>.<\/p>\n<p>Speaking of Kert Davies&#8217; Climate Files website link for Black Report material versus the other filings&#8217; links to Inside Climate News&#8217; PDF file for the same material, there is an odd thing going on within Sher Edgings&#8217; first six filings for <em>San Mateo \/ Marin Counties \/ City of Imperial Beach v. Chevron<\/em> and <em>Santa Cruz City \/ County \/ City of Richmond v. Chevron<\/em>. As seen in the prior paragraph&#8217;s screencapture for <em>San Mateo<\/em>, they all identically link to Kert Davies&#8217; site regarding the Black Report&#8217;s &#8220;time window&#8221; \/ &#8220;warming at the poles&#8221; line. But all six filings also feature an attachment cleverly titled &#8220;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/TorC-doc-links.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Exhibit A Truth or <span class=\"st\">CO<sub>2<\/sub><\/span>nsequences<\/a>,&#8221; which is a list of clickable links for a &#8220;<em>timeline <\/em>[that]<em> highlights information \u2026 from key industry documents and other sources<\/em>.&#8221; The specific info for the &#8220;Exhibit A Black Report&#8221; entry is <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/San-Mateo-Black-txt-v-Ex-A-1024x646.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">the same wording as the main text<\/a> in all six filings \u2026\u2026. except the link for it goes to Inside Climate News instead of Kert Davies&#8217; website.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/TorC-ICN-link.jpg\" \/><\/p>\n<p>What&#8217;s up with that?<\/p>\n<p>Is there something special about <a href=\"http:\/\/www.climatefiles.com\/exxonmobil\/1978-exxon-memo-on-greenhouse-effect-for-exxon-corporation-management-committee\/\" target=\"_blank\" rel=\"noopener noreferrer\">Kert Davies&#8217; Black Report scans<\/a> that are different than <a href=\"https:\/\/insideclimatenews.org\/sites\/default\/files\/documents\/James%20Black%201977%20Presentation.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ICN&#8217;s scans<\/a>? No, they are <strong><em>identical<\/em><\/strong>. Notice the little orange diagonal smudge and four surrounding dots at the top right corner of page 1 in both collections.<\/p>\n<p><img src=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Davies-smudge-ICNs-1024x539.jpg\" \/><\/p>\n<p>If the ICN &#8220;Exxon Knew&#8221; report series was the &#8211; again &#8211; be-all, end-all source for old Exxon documents, why would there be any need to create a new &#8216;Kert Davies middleman source&#8217; between these lawsuits and those document scans? Then there&#8217;s the counter opposite question about why these Sher Edling filings, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Charleston-reposit.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">including this latest <em>Charleston<\/em> one<\/a>, all link to the &#8216;middleman source&#8217; of the Union of Concerned Scientists for the scans of the worthless &#8220;reposition global warming memos&#8221; when they could instead link to Kert Davies&#8217; scan copies from &#8211; <strong><em>again<\/em><\/strong> &#8211; the time when <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2019\/08\/OA-staff-Passac-Davies2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">he worked at Ozone Action<\/a>, where it and Ross Gelbspan &#8216;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2016\/10\/OA-Gelb-obtained-v2.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">obtained<\/a>\u2019 those memos from a <strong><em>never-disclosed<\/em><\/strong> source.<\/p>\n<p>These global warming lawsuit filings are anything but &#8220;open and shut cases.&#8221; David Middleton and others point out sizable problems regarding what Exxon supposedly knew about the science, while <a href=\"https:\/\/eidclimate.org\/three-things-to-know-about-charleston-s-c-s-new-climate-lawsuit\/\" target=\"_blank\" rel=\"noopener noreferrer\">others point out the problems<\/a> with the operation and personnel behind these lawsuit filings. Myriad questions arise from all of this, which the defendant lawyers or prominent objective reporters might want to explore:<\/p>\n<ul>\n<li>was the &#8220;September mini-wave&#8221; of global warming lawsuit filings less of a &#8216;wave&#8217; if two of the four are identical, handled by the same law firm?<\/li>\n<li>is the overall &#8220;wave&#8221; of <a href=\"http:\/\/gelbspanfiles.com\/?page_id=18\" target=\"_blank\" rel=\"noopener noreferrer\">global warming lawsuit filings<\/a> over the last three years far less of a &#8216;wave&#8217; if <strong>over half of them<\/strong> apparently consist of pick-and-choose boilerplate copy elements from a single template that one law firm is using in its multiple filings, while the rest of the filings seemingly rely on an arguably too-similar-to-be-coincidental basic template? (not mentioned above, both <em>Boulder v Suncor<\/em> and <em>Massachusetts v Exxon<\/em>, each devoid of citation sources, <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Boulder-ICNs-Black.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">vaguely reference<\/a> what <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/Massachusetts-ICNs-Black.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">turns out to be obviously the Black Report<\/a>)<\/li>\n<li>is there actually any &#8216;wave&#8217; of lawsuits at all, when every one of these &#8220;Exxon Knew&#8221;-style lawsuits are similar enough that they could be consolidated into a single one of <em>John Passacantando, Kert Davies, et al. [dba <a href=\"http:\/\/gelbspanfiles.com\/?p=4482\" target=\"_blank\" rel=\"noopener noreferrer\">Greenpeace USA n\u00e9e Ozone Action<\/a> \/ <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/02\/Walrath-CIC-dark-money.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Our Next Economy \/ CIC<\/a> ] v Exxon<\/em>, considering how that duo and their apparent associates <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/05\/Davies-Passac-suspects.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">don&#8217;t like Exxon very much<\/a>, and how they may actually be the central leaders over the last 22 years behind the idea of &#8216;<a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2015\/02\/CorpLeglT-Pawa-Ozone.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">suing the fossil fuel industry for using counter-propaganda campaigns to deceive the public<\/a>.&#8217;<\/li>\n<li>is there a reason why <a href=\"http:\/\/gelbspanfiles.com\/wp-content\/uploads\/2020\/09\/EE-growing-landscape-more-robust.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">university analysts and supposedly unbiased news reporters<\/a> are unable to spot myriad faults which potentially fatally weaken these &#8220;climate misinformation lawsuits,&#8221; which otherwise become obvious after even just a moderately objective examination is undertaken of the finer points of the scientific part or the political part of the lawsuits?<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>In just the span of barely the first three weeks of September, four lawsuits suing energy companies for the costs of man-caused global warming were filed, City of Hoboken v.
